Stat. tit. 12, § 12-1148.5A","heading":"Constructive service of summons","body":"If, in the exercise of reasonable diligence, service cannot be\n\nmade upon the defendant personally nor upon any person residing upon\n\nthe premises over fifteen (15) years of age, then in lieu of service\n\nby certified mail, service may be obtained for the sole purpose of\n\nadjudicating the right to restitution of the premises by the\n\nsheriff's posting or by private process service posting of said\n\nsummons conspicuously on the building on the premises, and, if there\n\nbe no building on said premises, then by posting the same at some\n\nconspicuous place on the premises sought to be recovered at least\n\nfive (5) days prior to the date of trial, and by the claimant's\n\nmailing a copy of said summons to the last-known address of the\n\ndefendant by certified mail at least five (5) days prior to said\n\ndate of trial. Such service shall confer no jurisdiction upon the\n\ncourt to render any judgment against the defendant for the payment\n\nof money nor for any relief other than the restoration of possession\n\nof the premises to the claimant, unless the defendant appears at\n\ntrial. If the court only renders a judgment for restoration of\n\npossession of the premises, the claimant shall not be precluded from\n\npursuing a subsequent action for the payment of rent. A judgment\n\nfor forcible entry and detainer shall not preclude the property\n\nowner from pursuing a subsequent action for other monetary relief.\n\nSuch service shall not be rendered ineffectual by the failure of the\n\ndefendant to actually see or receive such posted process nor by the\n\nfailure of the defendant to actually receive or sign a return\n\nreceipt for such mailed process.","path":["OK Code","Title 12"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c162b29f52602124aff2155a7e270053c61714ed67a7c92dd4e5ba707b57a4f3","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12-12-1148.5","next":"us-ok/okla.-stat.-tit.-12-12-1148.6"},"notice":"GroundRules: Original legal text.
