Stat. tit. 12, § 12-1398","heading":"Injunction prohibiting workplace harassment – Employer","body":"liability.\n\nA. As used in the Protection from Workplace Harassment and\n\nViolence Act:\n\n1. \"Course of conduct\" means a pattern of conduct composed of a\n\nseries of two or more separate acts over a period of time, however\n\nshort, evidencing a continuity of purpose;\n\n2. \"Credible threat of violence\" is a knowing and willful\n\nstatement or course of conduct that would place a reasonable person\n\nin fear for his or her safety, or the safety of his or her immediate\n\nfamily, and that serves no legitimate purpose;\n\n3. \"Employer\" means an individual, partnership, association or\n\ncorporation or a person or group of persons who act, directly or\n\nindirectly, on behalf of or in the interest of an employer and with\n\nthe consent of the employer. \"Employer\" includes this state and any\n\npolitical subdivision of this state; and\n\n4. \"Workplace harassment\" means a pattern or course of conduct\n\nthat is directed toward another individual in a workplace that\n\nincludes repeated or continuing contact that would cause a\n\nreasonable person to suffer emotional distress and that actually\n\ncauses emotional distress to the victim. \"Workplace harassment\"\n\nincludes, but is not limited to, credible threats of violence.\n\nB. An employer or an authorized agent of an employer may file a\n\nwritten verified petition with the district court of the county in\n\nwhich the employer is located for an injunction prohibiting\n\nworkplace harassment. The petition shall state:\n\n1. The name of the employer;\n\n2. The name and address, if known, of the defendant; and\n\n3. A specific statement showing the events and dates of the\n\nacts that constitute workplace harassment toward the employer, any\n\nemployee or any person who enters the property of the employer or\n\nwho is performing official work duties on behalf of or for the\n\nbenefit of the employer.\n\nC. Any issuance of injunctive relief on a petition filed\n\npursuant to this section shall be in accordance with the procedural\n\nrequirements of Chapter 24 of Title 12 of the Oklahoma Statutes. If\n\nthe court grants an ex parte or permanent injunction against\n\nworkplace harassment, the court may:\n\n1. Restrain the defendant from coming near the property of the\n\nemployer or place of business and restrain the defendant from\n\ncontacting the employer, an employee or other person while that\n\nemployee or person is on or at the property of the employer or place\n\nof business or is performing official work duties; and\n\n2. Grant any other relief necessary for the protection of the\n\nemployer, the workplace, employees of the employer or any other\n\nperson who is on or at the property of the employer or place of\n\nbusiness or who is performing official work duties on behalf of or\n\nfor the benefit of the employer.\n\nD. An employer shall be immune from civil liability for seeking\n\nor failing to seek an injunction under this section unless the\n\nemployer is seeking an injunction primarily to accomplish a purpose\n\nfor which the injunction was not designed. This section shall not\n\nbe construed to:\n\n1. Expand, diminish, alter or modify the duty of an employer to\n\nprovide a safe workplace for employees and other persons; or\n\n2.
