Stat. tit. 12, § 12-140.3","heading":"Forum non conveniens – Considerations in motions to","body":"stay, transfer or dismiss.\n\nA. If the court, upon motion by a party or on the court's own\n\nmotion, finds that, in the interest of justice and for the\n\nconvenience of the parties, an action would be more properly heard\n\nin another forum either in this state or outside this state, the\n\ncourt shall decline to exercise jurisdiction under the doctrine of\n\nforum non conveniens and shall stay, transfer or dismiss the action.\n\nB. In determining whether to grant a motion to stay, transfer\n\nor dismiss an action pursuant to this section, the court shall\n\nconsider:\n\n1. Whether an alternate forum exists in which the action may be\n\ntried;\n\n2. Whether the alternate forum provides an adequate remedy;\n\n3. Whether maintenance of the action in the court in which the\n\ncase is filed would work a substantial injustice to the moving\n\nparty;\n\n4. Whether the alternate forum can exercise jurisdiction over\n\nall the defendants properly joined in the action of the plaintiff;\n\n5. Whether the balance of the private interests of the parties\n\nand the public interest of the state predominate in favor of the\n\naction being brought in an alternate forum; and\n\n6.
