Stat. tit. 12, § 12-1431","heading":"Definitions","body":"As used in the Oklahoma Citizens Participation Act:\n\n1. \"Communication\" means the making or submitting of a\n\nstatement or document in any form or medium, including oral, visual,\n\nwritten, audiovisual or electronic;\n\n2. \"Exercise of the right of association\" means a communication\n\nbetween individuals who join together to collectively express,\n\npromote, pursue or defend common interests;\n\n3. \"Exercise of the right of free speech\" means a communication\n\nmade in connection with a matter of public concern;\n\n4. \"Exercise of the right to petition\" means any of the\n\nfollowing:\n\na. a communication in or pertaining to:\n\n(1) a judicial proceeding,\n\n(2) an official proceeding, other than a judicial\n\nproceeding, to administer the law,\n\n(3) an executive or other proceeding before a\n\ndepartment or agency of the state or federal\n\ngovernment or a political subdivision of the\n\nstate or federal government,\n\n(4) a legislative proceeding, including a proceeding\n\nof a legislative committee,\n\n(5) a proceeding before an entity that requires by\n\nrule that public notice be given before\n\nproceedings of that entity,\n\n(6) a proceeding in or before a managing board of an\n\neducational or eleemosynary institution supported\n\ndirectly or indirectly from public revenue,\n\n(7) a proceeding of the governing body of any\n\npolitical subdivision of this state,\n\n(8) a report of or debate and statements made in a\n\nproceeding described by division (3), (4), (5),\n\n(6) or (7) of this subparagraph, or\n\n(9) a public meeting dealing with a public purpose,\n\nincluding statements and discussions at the\n\nmeeting or other matters of public concern\n\noccurring at the meeting,\n\nb. a communication in connection with an issue under\n\nconsideration or review by a legislative, executive,\n\njudicial or other governmental body or in another\n\ngovernmental or official proceeding,\n\nc. a communication that is reasonably likely to encourage\n\nconsideration or review of an issue by a legislative,\n\nexecutive, judicial or other governmental body or in\n\nanother governmental or official proceeding,\n\nd. a communication reasonably likely to enlist public\n\nparticipation in an effort to effect consideration of\n\nan issue by a legislative, executive, judicial or\n\nother governmental body or in another governmental or\n\nofficial proceeding, and\n\ne. any other communication that falls within the\n\nprotection of the right to petition government under\n\nthe Constitution of the United States or the Oklahoma\n\nConstitution;\n\n5. \"Governmental proceeding\" means a proceeding, other than a\n\njudicial proceeding, by an officer, official or body of this state\n\nor a political subdivision of this state, including an agency, board\n\nor commission, or by an officer, official or body of the federal\n\ngovernment;\n\n6. \"Legal action\" means a lawsuit, cause of action, petition,\n\ncomplaint, cross-claim, counterclaim or any other judicial pleading\n\nor filing that requests legal or equitable relief;\n\n7. \"Matter of public concern\" means an issue related to:\n\na. health or safety,\n\nb. environmental, economic or community well-being,\n\nc. the government,\n\nd. a public official or public figure, or\n\ne. a good, product or service in the marketplace;\n\n8. \"Official proceeding\" means any type of administrative,\n\nexecutive, legislative or judicial proceeding that may be conducted\n\nbefore a public servant; and\n\n9. \"Public servant\" means a person elected, selected,\n\nappointed, employed or otherwise designated as one of the following,\n\neven if the person has not yet qualified for office or assumed the\n\nperson's duties:\n\na. an officer, employee or agent of government,\n\nb. a juror,\n\nc. an arbitrator, referee or other person who is\n\nauthorized by law or private written agreement to hear\n\nor determine a cause or controversy,\n\nd. an attorney or notary public when participating in the\n\nperformance of a governmental function, or\nce or assumed the\n\nperson's duties:\n\na. an officer, employee or agent of government,\n\nb. a juror,\n\nc. an arbitrator, referee or other person who is\n\nauthorized by law or private written agreement to hear\n\nor determine a cause or controversy,\n\nd. an attorney or notary public when participating in the\n\nperformance of a governmental function, or\n\ne. a person who is performing a governmental function\n\nunder a claim of right but is not legally qualified to\n\ndo so.","path":["OK Code","Title 12"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"44564bdb526fdf4f054f64764b24ee60d5c2a332a3263babf36236a1546a2de5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12-12-1430","next":"us-ok/okla.-stat.-tit.-12-12-1432"},"notice":"GroundRules: Original legal text.
