Stat. tit. 12, § 12-1485","heading":"Judgment for occupying claimant - Appeal","body":"If the appraisers or jury appointed or impaneled as hereinbefore\n\nprovided, shall find that the value of the improvements is greater\n\nthan the value of the rents and damages and waste, then the court\n\nshall enter judgment that the successful claimant pay to the clerk\n\nof the court for the use of the occupying claimant the full amount\n\nof the excess of the value of the improvements over the value of the\n\nrents, damages and waste before the writ of ouster shall issue;\n\nProvided, that if either party shall deem himself aggrieved by the\n\njudgment and shall desire to contest either or both the findings of\n\nthe court or the appraisement of the appraisers or the jury herein\n\nprovided for, by appeals or otherwise, to a higher court, and the\n\nsuccessful claimant shall execute an undertaking to the occupying\n\nclaimant in double the amount of the excess in value as found by the\n\nappraisers or the jury, with good and sufficient surety to be\n\napproved by the clerk of the court, conditioned that he will pay\n\nsuch excess with interest from the date of the judgment, if the\n\njudgment be affirmed by the appellate court, then the writ of ouster\n\nshall, at the request of the successful claimant issue at once.","path":["OK Code","Title 12"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5603889cb2aeab924c41f47bc3018a1abcd700cd24bfe456cd7866076cbe49c7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12-12-1484","next":"us-ok/okla.-stat.-tit.-12-12-1486"},"notice":"GroundRules: Original legal text.
