When the object of the action is to effect a partition of\n\nreal property, the petition must describe the property and the\n\nrespective interests of the owners thereof, if known.\n\nB. 1. Except as provided for in this subsection, in any action\n\ninvolving the partition of a mineral estate, in addition to the\n\nrequirements of subsection A of this section, the petition shall\n\nspecify and the plaintiff shall establish at trial by a\n\npreponderance of the evidence that:\n\na. one or more of the co-owners of the mineral estate are\n\nfrustrating the development objective of the plaintiff\n\nfor the estate; and\n\nb. an order of the Corporation Commission to pool and\n\ndevelop said minerals pursuant to Section 87.1 of\n\nTitle 52 of the Oklahoma Statutes and a plan of\n\nunitization created pursuant to Sections 287.1 through\n\n287.15 of Title 52 of the Oklahoma Statutes would not\n\neffectuate a realization of the development objective.\n\n2. The provisions of this subsection shall not apply to any\n\naction involving the partition of a mineral estate, if the person\n\nrequesting the partition owns the surface estate or any part thereof\n\nand also owns an interest in the mineral estate.\n\nR.L. 1910, § 4940.
