In addition to other provisions of law, if, upon the filing\n\nof the commissioners' report, it appears that the property cannot be\n\npartitioned in kind and the value of the property does not exceed\n\nFive Thousand Dollars ($5,000.00), the court may forthwith dispense\n\nwith further regular partition proceedings and make an order\n\ndirecting the sheriff of the county to sell the property, in the\n\nsame manner, as in sales of real estate on execution at not less\n\nthan two-thirds (2/3) of the appraised value.\n\nB. In addition to the notice required for sales of real estate\n\non execution, notice of the sale shall be mailed with return receipt\n\nrequested at least twenty (20) days prior to the sale, to all\n\npersons owning an interest in the property or to their attorneys at\n\ntheir respective last-known address.\n\nC. If it can be established to the satisfaction of the court,\n\nprior to the sale, that such property is of a value in excess of\n\nFive Thousand Dollars ($5,000.00), such sale shall not be held and\n\nthe court shall appoint other commissioners to reappraise the\n\nproperty or refer the matter to the same commissioners.\n\nD. Confirmation of such sale shall be set for hearing not less\n\nthan ten (10) days after the day of sale. A written notice of\n\nhearing on the confirmation of the sale shall be mailed, by first-\n\nclass mail, postage prepaid, to all persons having an interest in\n\nthe property as previously determined by the court whose names and\n\naddresses are known, at least ten (10) days before the hearing on\n\nthe confirmation of the sale, and if the name or address of any such\n\nperson is unknown, such notice shall also be published in a\n\nnewspaper authorized by law to publish legal notices in each county\n\nin which the property is situated. If no newspaper authorized by\n\nlaw to publish legal notices is published in such county, the notice\n\nshall be published in some such newspaper of general circulation\n\nwhich is published in an adjoining county. The notice shall state\n\nthe name of the person or persons being notified by publication and\n\nshall be published once at least ten (10) days prior to the date of\n\nthe hearing on the notice of confirmation of the sale. An affidavit\n\nof proof of mailing and of publication, if publication is required,\n\nshall be filed in the case.\n\nE. Upon such hearing, if satisfied with the validity and\n\nfairness of the sale, the court shall order the sheriff to issue a\n\nsheriff's deed to the purchaser of the property and, after\n\napportionment of costs, attorney fees and expenses, direct\n\ndisbursement of the sale proceeds to those persons legally entitled\n\nto receive the same.","path":["OK Code","Title 12"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ef80706ad51b81393b31b36aa960311ed2e0f933d21556ca5087e8230fa9beab","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12-12-1516","next":"us-ok/okla.-stat.-tit.-12-12-1531"},"notice":"GroundRules: Original legal text.
