Stat. tit. 12, § 12-1578","heading":"Exception to sureties","body":"The plaintiff may, within twenty-four (24) hours from the time\n\nthe undertaking referred to in Section 1577 of this title is given\n\nby the defendant, give notice as hereinafter required that he\n\nexcepts to the sufficiency of the sureties. In the event plaintiff\n\nexcepts to the sufficiency of the defendant's sureties, said\n\nplaintiff will file written exceptions and notice in the district\n\ncourt in the case involved, and the court shall set a day for\n\nhearing said exceptions, provided, however, after notice of\n\nplaintiff's exceptions have been given to the defendant, he shall\n\nhave five (5) days within which to except to the sufficiency of\n\nplaintiff's sureties on the undertaking required of the plaintiff by\n\nSection 1573 above, and if a hearing is held on the exception by\n\neither party, the bonds of both shall be subject to scrutiny and a\n\ndecision made upon each by the district court at the same hearing.\n\nIf plaintiff or defendant fails to except, he shall be deemed to\n\nhave waived all objections to the sufficiency of the sureties\n\ninvolved. If either party excepts, the sureties must justify, upon\n\nnotice, as bail in criminal cases.\n\nR.L. 1910, § 4805.
