A district court may maintain a list of qualified mediators\n\nto assist the parties in selecting a mediator. In order to be\n\nplaced on any such list, an individual shall meet the following\n\nminimum requirements:\n\n1. Civil and commercial mediators shall:\n\na. be certified pursuant to the Dispute Resolution Act,\n\nor\n\nb. (1) complete a minimum of twenty-four (24) hours of\n\nmediation training, which training has been\n\napproved by the Mandatory Continuing Legal\n\nEducation Commission of the Oklahoma Bar\n\nAssociation,\n\n(2) observe a minimum of two (2) mediation\n\nproceedings, and\n\n(3) complete at least six (6) hours every other year\n\nof continuing professional education in the area\n\nof mediation, which education has been approved\n\nby the Mandatory Continuing Legal Education\n\nCommission of the Oklahoma Bar Association; and\n\n2. Divorce and Family Mediators shall:\n\na. be certified for family and divorce mediation pursuant\n\nto the Dispute Resolution Act, or\n\nb. (1) complete forty (40) hours of training in family\n\nand divorce mediation, which training has been\n\napproved by the Mandatory Continuing Legal\n\nEducation Commission of the Oklahoma Bar\n\nAssociation,\n\n(2) conduct at least twelve (12) hours of mediation\n\nwith three (3) separate families, and\n\n(3) complete at least six (6) hours every other year\n\nof professional education in the area of family\n\nmediation, or\n\nc. have been regularly engaged in the practice of family\n\nand divorce mediation for at least four (4) years.\n\nB. Nothing in this act shall preclude the parties from\n\nagreeing:\n\n1. To participate in any alternative dispute resolution\n\nprocess, including mediation, independent of this act or any related\n\ncourt order; or\n\n2. To select a mediator not identified on any list of qualified\n\nmediators maintained by the district court.\n\nC. Mediators who are not certified pursuant to the Dispute\n\nResolution Act, upon request by the court, any party, or legal\n\ncounsel, shall provide information demonstrating the mediator's\n\ncompliance with the requirements of Section 4 of this act, and shall\n\nagree to adhere to the Model Standards of Conduct for Mediators\n\napproved by the Litigation and Dispute Resolution Sections of the\n\nAmerican Bar Association, the American Arbitration Association, and\n\nthe Society of Professionals in Dispute Resolution.\n\nD. The following form shall be used to order mediation pursuant\n\nto this act:\n\nIN THE DISTRICT COURT OF ____________________ COUNTY\n\nSTATE OF OKLAHOMA\n\nOrder of Referral To Mediation\n\nThis case is ordered to mediation pursuant to the District Court\n\nMediation Act. Parties and legal counsel shall proceed in good\n\nfaith to resolve this case. The parties shall select and\n\ncontact a mediator or mediation program or service within five\n\n(5) business days to make appropriate arrangements for the\n\nmediation proceeding. Mediation shall be completed within _____\n\ndays from the date of this order.\n\nMediation shall be attended by persons with full settlement\n\nauthority. Both parties shall participate in mediation;\n\nattorneys may participate as agreed by the parties and the\n\nmediator. Named parties shall be present except for a named\n\nparty who has no interest in the outcome and no settlement\n\nauthority. Each party who is represented by legal counsel shall\n\nbe accompanied at mediation by an attorney who is fully familiar\n\nwith the case.
