In computing any period of time prescribed\n\nor allowed by this title, by the rules of any court of this state,\n\nor by order of a court of this state, the day of the act, event, or\n\ndefault from which the designated period of time begins to run shall\n\nnot be included. The last day of the period so computed shall be\n\nincluded, unless it is a legal holiday as defined by Section 82.1 of\n\nTitle 25 of the Oklahoma Statutes or any other day when the office\n\nof the court clerk does not remain open for public business until\n\nthe regularly scheduled closing time, in which event the period runs\n\nuntil the end of the next day which is not a legal holiday or a day\n\nwhen the office of the court clerk does not remain open for public\n\nbusiness until the regularly scheduled closing time. Except for the\n\ntimes provided in Sections 765, 990.3, 1148.4, 1148.5, 1148.5A, and\n\n1756 of this title, when the period of time prescribed or allowed is\n\nless than eleven (11) days, intermediate legal holidays and any\n\nother day when the office of the court clerk does not remain open\n\nfor public business until the regularly scheduled closing time,\n\nshall be excluded from the computation.\n\n2. For actions filed on or after November 1, 1999, and on or\n\nbefore June 30, 2000, any period of time prescribed or allowed by\n\nthis title, by the rules of any court, by an order of a court, or by\n\nany applicable statute, shall be computed pursuant to the shortest\n\ntime prescribed by the law in effect before November 1, 1999, the\n\nlaw in effect prior to the effective date of this act, or this act,\n\nunless the court finds that to do so would result in injustice.\n\nB. ENLARGEMENT. When by this title or by a notice given\n\nthereunder by order of court an act is required or allowed to be\n\ndone at or within a specified time, the court for cause shown may at\n\nany time in its discretion:\n\n1. With or without motion or notice order the period enlarged\n\nif request therefor is made before the expiration of the period\n\noriginally prescribed or as extended by a previous order; or\n\n2. Upon motion made after the expiration of the specified\n\nperiod permit the act to be done where the failure to act was the\n\nresult of excusable neglect; but it may not extend the time set\n\nforth in this title for taking an appeal from a judgment, decree or\n\nappealable order, or for seeking a new trial, a judgment\n\nnotwithstanding the verdict, or to correct, open, modify, vacate or\n\nreconsider a judgment, decree, or appealable order, except as\n\nprovided in the sections governing such proceedings.\n\nC. FOR MOTIONS - AFFIDAVITS. A written motion, other than one\n\nwhich may be heard ex parte, and notice of the hearing thereof,\n\nshall be served not later than five (5) days before the time\n\nspecified for the hearing, unless a different period is fixed by the\n\nOklahoma Statutes, court rules, or by an order of the court. Such\n\nan order may for cause shown be made on ex parte application. When\n\na motion is supported by affidavit, the affidavit shall be served\n\nwith the motion.\n\nD. ADDITIONAL TIME AFTER SERVICE BY MAIL, THIRD-PARTY\n\nCOMMERCIAL CARRIER OR ELECTRONIC MEANS. Whenever a party has the\n\nright or is required to do some act or take some proceedings within\n\na prescribed period after the service of a notice or other paper\n\nupon the party and the notice or paper is served upon the party by\n\nmail, third-party commercial carrier or electronic means, three (3)\n\ndays shall be added to the prescribed period; provided, however,\n\nwhen a summons and petition are served by mail, a defendant shall\n\nserve an answer within twenty (20) days or thirty-five (35) days if\n\npursuant to subsection A of Section 2012 of this title, after the\n\ndate of receipt or if refused, the date of refusal of the summons\n\nand petition by the defendant.","path":["OK Code","Title 12"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5c0d8f3ef62c41fb70d2ac954f861a7acd1959e87d31583ce8a57d380502f978","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12-12-2005.2","next":"us-ok/okla.-stat.-tit.-12-12-2007"},"notice":"GroundRules: Original legal text.
