Except as otherwise provided in subsection B of this\n\nsection, this Code shall apply in both criminal and civil\n\nproceedings, conducted by or under the supervision of a court, in\n\nwhich evidence is produced.\n\nB. The rules set forth in this Code, other than those\n\napplicable to a valid claim of privilege, do not apply in the\n\nfollowing situations:\n\n1. The determination of questions of fact preliminary to\n\nadmissibility of evidence when the issue is to be determined by the\n\njudge under subsection A of Section 2105 of this title; and\n\n2.
