A communication is confidential for purposes of this section\n\nif it is made privately by any person to the person’s spouse and is\n\nnot intended for disclosure to any other person.\n\nB. An accused in a criminal proceeding has a privilege to\n\nprevent the spouse of the accused from testifying as to any\n\nconfidential communication between the accused and the spouse.\n\nC. The privilege may be claimed by the accused or by the spouse\n\non behalf of the accused. The authority of the spouse to do so is\n\npresumed.\n\nD. There is no privilege under this section in a proceeding in\n\nwhich one spouse is charged with a crime against the person or\n\nproperty of:\n\n1. The other;\n\n2. A child of either;\n\n3. A person residing in the household of either; or\n\n4.
