As used in this section:\n\n1. \"State proceeding\" includes any proceeding or investigation\n\nbefore or by any judicial, legislative, executive or administrative\n\nbody in this state;\n\n2. \"Medium of communication\" includes any newspaper, magazine,\n\nother periodical, book, pamphlet, news service, wire service, news\n\nor feature syndicate, broadcast station or network, cable television\n\nsystem, or record;\n\n3. \"Information\" includes any written, oral or pictorial news\n\nor other record;\n\n4. \"Published information\" means any information disseminated\n\nto the public by the person from whom disclosure is sought;\n\n5. \"Unpublished information\" includes information not\n\ndisseminated to the public by the person from whom disclosure is\n\nsought, whether or not related information has been disseminated,\n\nand includes, but is not limited to, all notes, outtakes,\n\nphotographs, tapes or other data of whatever sort not itself\n\ndisseminated to the public through a medium of communication,\n\nwhether or not published information based upon or related to such\n\nmaterial has been disseminated;\n\n6. \"Processing\" includes compiling, storing and editing of\n\ninformation; and\n\n7. \"Journalist\" means any person who is a reporter,\n\nphotographer, editor, commentator, journalist, correspondent,\n\nannouncer, or other individual regularly engaged in obtaining,\n\nwriting, reviewing, editing, or otherwise preparing news for any\n\nnewspaper, periodical, press association, newspaper syndicate, wire\n\nservice, radio or television station, or other news service. Any\n\nindividual employed by any such news service in the performance of\n\nany of the above-mentioned activities shall be deemed to be\n\nregularly engaged in such activities. However, journalist shall not\n\ninclude any governmental entity or individual employed thereby\n\nengaged in official governmental information activities.\n\nB. No journalist shall be required to disclose in a state\n\nproceeding either:\n\n1. The source of any published or unpublished information\n\nobtained in the gathering, receiving or processing of information\n\nfor any medium of communication to the public; or\n\n2. Any unpublished information obtained or prepared in\n\ngathering, receiving or processing of information for any medium of\n\ncommunication to the public; unless the court finds that the party\n\nseeking the information or identity has established by clear and\n\nconvincing evidence that such information or identity is relevant to\n\na significant issue in the action and could not with due diligence\n\nbe obtained by alternate means.\n\nThis subsection does not apply with respect to the content or\n\nsource of allegedly defamatory information, in a civil action for\n\ndefamation wherein the defendant asserts a defense based on the\n\ncontent or source of such information.","path":["OK Code","Title 12"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c025923151d0d3a5a41409a72c1d2efd52018679873fdd563400d146094f6a0e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12-12-2505","next":"us-ok/okla.-stat.-tit.-12-12-2506.1"},"notice":"GroundRules: Original legal text.
