A \"statement\" means:\n\na. an oral assertion,\n\nb. an assertion in a record, or\n\nc. nonverbal conduct of a person, if it is intended by a\n\nperson as an assertion;\n\n2. A \"declarant\" means a person who makes a statement; and\n\n3. \"Hearsay\" means a statement, other than one made by the\n\ndeclarant while testifying at the trial or hearing, offered in\n\nevidence to prove the truth of the matter asserted.\n\nB. A statement is not hearsay if:\n\n1. The declarant testifies at the trial or hearing and is\n\nsubject to cross-examination concerning the statement, and the\n\nstatement is:\n\na. inconsistent with the declarant's testimony, and was\n\ngiven under oath subject to the penalty of perjury at\n\na trial, hearing or other proceeding, or in a\n\ndeposition, or\n\nb. consistent with the declarant's testimony and is\n\noffered to rebut an express or implied charge against\n\nthe declarant of recent fabrication or improper\n\ninfluence or motive and was made before the supposed\n\nfabrication, influence, or motive arose, or\n\nc. one of identification of a person made after\n\nperceiving the person; or\n\n2.
