Stat. tit. 12, § 12-3226.2","heading":"Commercial litigation funder and commercial litigation","body":"funding agreement defined.\n\nAs used in the Oklahoma Discovery Code:\n\n1. \"Commercial litigation funder\" means any person or entity,\n\nother than an attorney permitted to charge a contingent fee for\n\nrepresenting a party, that enters into a contract establishing a\n\nright to receive compensation that is contingent on and sourced from\n\nany proceeds of the civil action by settlement, judgment, or\n\notherwise. Commercial litigation funder shall not include a\n\nconsumer litigation funder as defined in Section 3-801 of Title 14A\n\nof the Oklahoma Statutes; and\n\n2. \"Commercial litigation funding agreement\" means an agreement\n\nunder which the commercial litigation funder is granted a right to\n\nreceive compensation contingent on and sourced from any proceeds of\n\na civil action by settlement, judgment, or otherwise. A commercial\n\nlitigation funding agreement shall not include:\n\na. legal representation services provided on a\n\ncontingency fee basis or legal costs advanced by a\n\nlegal representative where such services or costs are\n\nprovided to or on behalf of a client by an attorney\n\nrepresenting the party in the dispute and in\n\naccordance with the Oklahoma Rules of Professional\n\nConduct,\n\nb. an agreement entered into between an attorney or law\n\nfirm and a commercial litigation funder or any other\n\nentity. Sharing of fees by an attorney or law firm\n\nshall be in accordance with the Oklahoma Rules of\n\nProfessional Conduct including but not limited to\n\nRules 1.5 and 5.4 of Appendix 3-A of Title 5 of the\n\nOklahoma Statutes, or\n\nc. a consumer litigation funding agreement as defined in\n\nSection 3-801 of Title 14A of the Oklahoma Statutes.","path":["OK Code","Title 12"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"96add75ab153dfd89903f633f1d08605e18676fb3e2b4528886d1d926ff053ae","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12-12-3226.1","next":"us-ok/okla.-stat.-tit.-12-12-3226a"},"notice":"GroundRules: Original legal text.
