Stat. tit. 12, § 12-3242","heading":"Discharge and release from liability","body":"Following a transfer of structured settlement payment rights\n\nunder the Structured Settlement Protection Act of 2001:\n\n1. The structured settlement obligor and the annuity issuer\n\nshall, as to all parties except the transferee, be discharged and\n\nreleased from any and all liability for the transferred payments;\n\n2. The transferee shall be liable to the structured settlement\n\nobligor and the annuity issuer:\n\na. if the transfer contravenes the terms of the\n\nstructured settlement, for any taxes incurred by such\n\nparties as a consequence of the transfer, and\n\nb. for any other liabilities or costs, including\n\nreasonable costs and attorneys’ fees, arising from\n\ncompliance by the parties with the order of the court\n\nor responsible administrative authority or arising as\n\na consequence of the transferee’s failure to comply\n\nwith this act;\n\n3. Neither the annuity issuer nor the structured settlement\n\nobligor may be required to divide any periodic payment between the\n\npayee and any transferee or assignee or between two or more\n\ntransferees or assignees; and\n\n4.
