Stat. tit. 12, § 12-3244","heading":"Waiver of provisions – Disputes - Life-contingent","body":"payments - Liability.\n\nA. The provisions of the Structured Settlement Protection Act\n\nof 2001 may not be waived by any payee.\n\nB. Any transfer agreement entered into on or after the\n\neffective date of this act by a payee who resides in this state\n\nshall provide that disputes under such transfer agreement, including\n\nany claim that the payee has breached the agreement, shall be\n\ndetermined in and under the laws of this state. No such transfer\n\nagreement shall authorize the transferee or any other party to\n\nconfess judgment or consent to entry of judgment against the payee.\n\nC. No transfer of structured settlement payment rights shall\n\nextend to any payments that are life-contingent unless, prior to the\n\ndate on which the payee signs the transfer agreement, the transferee\n\nhas established and has agreed to maintain procedures reasonably\n\nsatisfactory to the annuity issuer and the structured settlement\n\nobligor for\n\n1. Periodically confirming the payee’s survival; and\n\n2. Giving the annuity issuer and the structured settlement\n\nobligor prompt written notice in the event of the payee’s death.\n\nD. No payee who proposes to make a transfer of structured\n\nsettlement payment rights shall incur any penalty, forfeit any\n\napplication fee or other payment, or otherwise incur any liability\n\nto the proposed transferee or any assignee based on any failure of\n\nsuch transfer to satisfy the conditions of this act.\n\nE. Nothing contained in this act shall be construed to\n\nauthorize any transfer of structured settlement payment rights in\n\ncontravention of any law or to imply that any transfer under a\n\ntransfer agreement entered into prior to the effective date of this\n\nact is valid or invalid.\n\nF. Compliance with the requirements set forth in Section 3 of\n\nthis act and fulfillment of the conditions set forth in Section 4 of\n\nthis act shall be solely the responsibility of the transferee in any\n\ntransfer of structured settlement payment rights, and neither the\n\nstructured settlement obligor nor the annuity issuer shall bear any\n\nresponsibility for, or any liability arising from, noncompliance\n\nwith such requirements or failure to fulfill such conditions.","path":["OK Code","Title 12"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1c91edb0156380f269f27eb3c9bc08606c27cf960eb667b67e1f6555000b1139","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12-12-3243","next":"us-ok/okla.-stat.-tit.-12-12-3245"},"notice":"GroundRules: Original legal text.
