Stat. tit. 12, § 12-3302","heading":"Definitions","body":"DEFINITIONS.\n\nAs used in this act:\n\n1. “Collaborative law communication” means a statement, whether\n\noral or in a record, or verbal or nonverbal, that:\n\na. is made to conduct, participate in, continue, or\n\nreconvene a collaborative law process, and\n\nb. occurs after the parties sign a collaborative law\n\nparticipation agreement and before the collaborative\n\nlaw process is concluded;\n\n2. “Collaborative law participation agreement” means an\n\nagreement by persons to participate in a collaborative law process;\n\n3. “Collaborative law process” means a procedure intended to\n\nresolve a collaborative matter without intervention by a tribunal in\n\nwhich persons:\n\na. sign a collaborative law participation agreement, and\n\nb. are represented by collaborative lawyers;\n\n4. “Collaborative lawyer” means a lawyer who represents a party\n\nin a collaborative law process;\n\n5. “Collaborative matter” means a dispute, transaction, claim,\n\nproblem, or issue for resolution, including a dispute, claim, or\n\nissue in a proceeding, which is described in a collaborative law\n\nparticipation agreement;\n\n6. “Law firm” means:\n\na. lawyers who practice law together in a partnership,\n\nprofessional corporation, sole proprietorship, limited\n\nliability company, or association, and\n\nb. lawyers employed in a legal services organization, or\n\nthe legal department of a corporation or other\n\norganization, or the legal department of a government\n\nor governmental subdivision, agency, or\n\ninstrumentality;\n\n7. “Nonparty participant” means a person, other than a party\n\nand the party’s collaborative lawyer, that participates in a\n\ncollaborative law process;\n\n8. “Party” means a person that signs a collaborative law\n\nparticipation agreement and whose consent is necessary to resolve a\n\ncollaborative matter;\n\n9. “Person” means an individual, corporation, business trust,\n\nestate, trust, partnership, limited liability company, association,\n\njoint venture, public corporation, government or governmental\n\nsubdivision, agency, or instrumentality, or any other legal or\n\ncommercial entity;\n\n10. “Proceeding” means:\n\na. a judicial, administrative, arbitral, or other\n\nadjudicative process before a tribunal, including\n\nrelated prehearing and post-hearing motions,\n\nconferences, and discovery, or\n\nb. a legislative hearing or similar process;\n\n11. “Prospective party” means a person that discusses with a\n\nprospective collaborative lawyer the possibility of signing a\n\ncollaborative law participation agreement;\n\n12. “Record” means information that is inscribed on a tangible\n\nmedium or that is stored in an electronic or other medium and is\n\nretrievable in perceivable form;\n\n13. “Related to a collaborative matter” means involving the\n\nsame parties, transaction or occurrence, nucleus of operative fact,\n\ndispute, claim, or issue as the collaborative matter;\n\n14. “Sign” means, with present intent to authenticate or adopt\n\na record:\n\na. to execute or adopt a tangible symbol, or\n\nb. to attach to or logically associate with the record an\n\nelectronic symbol, sound, or process; and\n\n15. “Tribunal” means:\n\na. a court, arbitrator, administrative agency, or other\n\nbody acting in an adjudicative capacity which, after\n\npresentation of evidence or legal argument, has\n\njurisdiction to render a decision affecting a party’s\n\ninterests in a matter, or\n\nb. a legislative body conducting a hearing or similar\n\nprocess.","path":["OK Code","Title 12"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"87bccf6fcaab3103271775f55a999992c6b51360d3e3f0fda307bea2bde8b797","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12-12-3301","next":"us-ok/okla.-stat.-tit.-12-12-3303"},"notice":"GroundRules: Original legal text.
