Stat. tit. 12, § 12-3314","heading":"Appropriateness of collaborative law process","body":"APPROPRIATENESS OF COLLABORATIVE LAW PROCESS.\n\nBefore a prospective party signs a collaborative law\n\nparticipation agreement, a prospective collaborative lawyer shall:\n\n1. Assess with the prospective party factors the lawyer\n\nreasonably believes relate to whether a collaborative law process is\n\nappropriate for the prospective party’s matter;\n\n2. Provide the prospective party with information that the\n\nlawyer reasonably believes is sufficient for the party to make an\n\ninformed decision about the material benefits and risks of a\n\ncollaborative law process as compared to the material benefits and\n\nrisks of other reasonably available alternatives for resolving the\n\nproposed collaborative matter, such as litigation, mediation,\n\narbitration, or expert evaluation; and\n\n3. Advise the prospective party that:\n\na. after signing an agreement if a party initiates a\n\nproceeding or seeks tribunal intervention in a pending\n\nproceeding related to the collaborative matter, the\n\ncollaborative law process terminates,\n\nb. participation in a collaborative law process is\n\nvoluntary and any party has the right to terminate\n\nunilaterally a collaborative law process with or\n\nwithout cause, and\n\nc. the collaborative lawyer and any lawyer in a law firm\n\nwith which the collaborative lawyer is associated may\n\nnot appear before a tribunal to represent a party in a\n\nproceeding related to the collaborative matter, except\n\nas authorized by subsection C of Section 9 of this\n\nact, subsection B of Section 10 of this act, or\n\nsubsection B of Section 11 of this act.","path":["OK Code","Title 12"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2704a97c4bd9cf778650327a66626d5a8070954b5b49666b159cf6ba1e4f4d3d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12-12-3313","next":"us-ok/okla.-stat.-tit.-12-12-3315"},"notice":"GroundRules: Original legal text.
