Stat. tit. 12, § 12-3320","heading":"Authority of tribunal in case of noncompliance","body":"AUTHORITY OF TRIBUNAL IN CASE OF NONCOMPLIANCE.\n\nA. If an agreement fails to meet the requirements of Section 4\n\nof this act, or a lawyer fails to comply with Section 14 or 15 of\n\nthis act, a tribunal may nonetheless find that the parties intended\n\nto enter into a collaborative law participation agreement if they:\n\n1. Signed a record indicating an intention to enter into a\n\ncollaborative law participation agreement; and\n\n2. Reasonably believed they were participating in a\n\ncollaborative law process.\n\nB. If a tribunal makes the findings specified in subsection A\n\nof this section, and the interests of justice require, the tribunal\n\nmay:\n\n1. Enforce an agreement evidenced by a record resulting from\n\nthe process in which the parties participated;\n\n2. Apply the disqualification provisions of Sections 5, 6, 9,\n\n10, and 11 of this act; and\n\n3.
