Stat. tit. 12, § 12-54","heading":"Must execute and return process - Execution by county clerk","body":"when sheriff disqualified.\n\nHe shall execute every summons, order or other process, and\n\nreturn the same as required by law; and if he fail to do so, unless\n\nhe make it appear to the satisfaction of the court that he was\n\nprevented by inevitable accident from so doing, he shall be amerced\n\nby the court in a sum not exceeding One Thousand Dollars\n\n($1,000.00), upon motion and ten (10) days' notice, and shall be\n\nliable to the action of any person aggrieved by such failure.\n\nProvided that whenever any party, his agent or attorney, shall make\n\nand file with the clerk of the proper court an affidavit, stating\n\nthat he believes that the sheriff of said county will not, by reason\n\nof either partiality, prejudice, consanguinity or interest,\n\nfaithfully perform his duties in any suit commenced in said court,\n\nthe clerk shall direct the original, or other process, in such suit\n\nto the county clerk who shall execute the same in like manner as the\n\nsheriff might or ought to have done, and who shall be subject to the\n\nsame penalties as the sheriff if he fail to do so, unless he make it\n\nappear that he was prevented by inevitable accident from so doing,\n\nand the county clerk shall perform all of the other duties of the\n\nsheriff when the sheriff shall be a party to the case, or is\n\ndisqualified.","path":["OK Code","Title 12"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"83d8baaecaec6de8857a85e4d86a2742afe671ebc8a7011cd781bafeb33030eb","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12-12-53","next":"us-ok/okla.-stat.-tit.-12-12-55"},"notice":"GroundRules: Original legal text.
