Stat. tit. 12, § 12-651","heading":"New trial - Definition - Causes for","body":"A new trial is a reexamination in the same court, of an issue of\n\nfact or of law or both, after a verdict by a jury, the approval of\n\nthe report of a referee, or a decision by the court. The former\n\nverdict, report, or decision shall be vacated, and a new trial\n\ngranted, on the application of the party aggrieved, for any of the\n\nfollowing causes, affecting materially the substantial rights of the\n\nparty:\n\n1. Irregularity in the proceedings of the court, jury, referee,\n\nor prevailing party, or any order of the court or referee, or abuse\n\nof discretion, by which the party was prevented from having a fair\n\ntrial;\n\n2. Misconduct of the jury or a prevailing party;\n\n3. Accident or surprise, which ordinary prudence could not have\n\nguarded against;\n\n4. Excessive or inadequate damages, appearing to have been\n\ngiven under the influence of passion or prejudice;\n\n5. Error in the assessment of the amount of recovery, whether\n\ntoo large or too small, where the action is upon a contract, or for\n\nthe injury or detention of property;\n\n6. That the verdict, report, or decision is not sustained by\n\nsufficient evidence, or is contrary to law;\n\n7. Newly discovered evidence, material for the party applying,\n\nwhich could not, with reasonable diligence, have been discovered and\n\nproduced at the trial;\n\n8. Error of law occurring at the trial, and objected to by the\n\nparty making the application; or\n\n9. When, without fault of the complaining party, it becomes\n\nimpossible to prepare a record for an appeal.\n\nR.L. 1910, § 5033.
