For the purposes of this section only, a \"foreign defamation\n\njudgment\" shall mean any judgment for a cause of action equivalent\n\nor fundamentally similar to an action for libel or slander that is\n\nrendered by a court or tribunal outside the United States or its\n\nterritories or possessions. This section shall not apply to any\n\njudgment for defamation, slander or libel rendered by a federal\n\ncourt or a court or tribunal in this or any other state of the\n\nUnited States, an American Indian tribe recognized by the United\n\nStates, or one of the United States territories or possessions.\n\nB. In addition to any other defenses that may exist, no foreign\n\ndefamation judgment shall be recognized or enforced if:\n\n1. It is determined by a court of this state that the judgment\n\nwas rendered by a judicial system that does not provide impartial\n\ntribunals or procedures substantially compatible with the\n\nrequirements of due process of law applicable to courts of this\n\nstate;\n\n2. The court or tribunal issuing the foreign defamation\n\njudgment did not have personal jurisdiction over the defendant in\n\naccordance with the principles applicable under Oklahoma law; or\n\n3. The court or tribunal issuing the foreign defamation\n\njudgment did not have subject matter jurisdiction over the action.\n\nC. A foreign defamation judgment shall not be recognized by any\n\ncourt of this state until it is established by a preponderance of\n\nthe evidence that the defamation, libel or slander law applied in\n\nthe foreign defamation court's jurisdiction provides the same or\n\nhigher protection for freedom of speech and press as would be\n\nprovided under both the United States and Oklahoma Constitutions.\n\nIf it is determined that the law in the foreign defamation\n\njudgment's jurisdiction provides the same or greater protection,\n\nthen the court may proceed to consider if the judgment shall be\n\nrecognized as a foreign judgment. If it is determined that the law\n\nin the foreign defamation judgment's jurisdiction does not provide\n\nthe same or greater protection, or if no finding is made on this\n\npoint, then the court shall not recognize or enforce the foreign\n\ndefamation judgment and the judgment shall be void.\n\nD. For the purpose of rendering declaratory relief with respect\n\nto a person's liability for a foreign defamation judgment and\n\ndetermining whether the foreign defamation judgment should be deemed\n\nnonrecognizable, this state's courts have personal jurisdiction over\n\nany person who obtains a foreign defamation judgment against any\n\nperson who:\n\n1. Is a resident of this state;\n\n2. Is a person or entity amenable to the jurisdiction of this\n\nstate;\n\n3. Has assets in this state; or\n\n4. May have to take action in this state to comply with the\n\nforeign defamation judgment.\n\nE.
