No goods or chattels levied upon by an officer pursuant\n\nto an execution issued by a court of record shall be sold unless the\n\nparty causing the execution to be issued:\n\na. causes a written notice of sale executed by the\n\nsheriff describing the goods or chattels subject to\n\nsale and stating the date, time, and place where the\n\nsale shall occur and, if the sale is to utilize an\n\nonline auction marketplace, stating the sale will be\n\nconducted through an online auction marketplace, the\n\nInternet address where bids may be entered, the date\n\nof the sale, and the time when bidding is scheduled to\n\nbe open, to be mailed, by first-class mail, postage\n\nprepaid, to the judgment debtor, any holder of record\n\nof an interest in the property, and all other persons\n\nof whom the party causing the execution to be issued\n\nhas notice who claim a lien or any interest in the\n\ngoods or chattels, at least ten (10) days prior to the\n\ndate of the sale, if the names and actual addresses of\n\nsuch persons are known,\n\nb. causes public notice to be given of the date, time and\n\nplace of sale, for at least ten (10) days before the\n\nday of sale. The notice shall be executed by the\n\nsheriff and shall state the name of any person having\n\nan interest in the property whose actual address is\n\nunknown, and shall designate the person or persons\n\nwhose unknown successors are being notified. The\n\nnotice shall be given by advertisement, published in\n\nsome newspaper published in the county, or, in case no\n\nnewspaper is published therein, by setting up\n\nadvertisements in five public places in the county.\n\nTwo advertisements shall be put up in the township\n\nwhere the sale is to be held, and\n\nc. files in the case an affidavit of proof of mailing and\n\nof publication or posting.\n\n2. A written notice of sale executed prior to November 1, 1987,\n\nby the party causing the execution to be issued but otherwise\n\nconforming to the provisions of this section shall, for all\n\npurposes, be deemed valid.\n\nB. 1. If a purchaser other than the party causing the\n\nexecution to be issued, when required by the sheriff, fails to post\n\ncash or certified funds equal to ten percent (10%) of the amount bid\n\nfor the property within twenty-four (24) hours of the sale,\n\nexcluding Sundays and legal holidays, or otherwise fails to complete\n\nthe sale, the sheriff may proceed with the sale and may accept the\n\nnext highest bid.\n\n2. When goods and chattels levied upon cannot be sold for want\n\nof bidders, the officer making such return shall affix a true and\n\ncorrect inventory of such goods and chattels to the execution, and\n\nthe party causing such execution to be issued may thereupon sue out\n\nanother writ of execution, directing the sale of the property levied\n\nupon as provided for in this section.\n\nC. The sheriff may determine whether the sale provided for in\n\nthis section shall utilize an online auction marketplace. All sales\n\nof goods and chattels conducted by a sheriff utilizing an online\n\nauction marketplace shall be conducted in accordance with the\n\nprovisions of Section 4 of this act.\n\nR.L. 1910, § 5159.
