The Attorney General shall allocate funds from the Legal\n\nServices Revolving Fund to provide legal representation to indigent\n\npersons in this state in civil legal matters to the extent that\n\nfunds are available from the Legal Services Revolving Fund. The\n\nAttorney General shall be responsible for allocating these funds\n\npursuant to contract with eligible regional or statewide\n\norganizations which ordinarily render legal services to indigent\n\npersons. The Attorney General may charge an administrative fee for\n\nadministering the contracts. The funds shall be allocated for the\n\nbenefit of indigent clients in all seventy-seven (77) counties of\n\nthe state on a pro rata basis, utilizing an allocation formula that\n\ndistributes funds according to the number of residents whose incomes\n\nare less than the official United States federal poverty guidelines,\n\nbased on the United States census data, as a percentage of the total\n\nnumber of these residents in this state and which reserves funds for\n\nservices for specialized areas of law.\n\nB. As used in this section, \"eligible organization\" means an\n\nentity that:\n\n1. Is organized as a not-for-profit corporation that is tax\n\nexempt pursuant to the provisions of paragraph (3) of subsection (c)\n\nof Section 501 of the United States Internal Revenue Code of 1986,\n\nas amended;\n\n2. Has as its primary purpose the furnishing of legal\n\nassistance to eligible clients;\n\n3. Has a board of directors or other governing body the\n\nmajority of which is comprised of attorneys who are admitted to\n\npractice in this state and who are approved to serve on such body by\n\nthe governing bodies of the state or county bar associations and has\n\nat least one-third (1/3) of the membership who, when selected, are\n\neligible clients; and\n\n4. Is incorporated pursuant to any applicable laws of this\n\nstate.\n\nC. As a condition of the contract, the organization shall be\n\nrequired to determine the eligibility of any person seeking legal\n\nservices pursuant to this section.\n\nD. The Attorney General shall prepare annually and distribute\n\nto the Judiciary committees of the Senate and the House of\n\nRepresentatives and the Legal Services Committee of the Oklahoma Bar\n\nAssociation a report detailing expenditures of funds for\n\nrepresentation to indigent persons in civil legal matters.\n\nE. Each organization that contracts to provide legal services\n\npursuant to subsection A of this section shall maintain books and\n\nrecords in accordance with generally accepted accounting principles.\n\nThe books and records shall account for the receipt and expenditure\n\nof all funds paid pursuant to contract. Books and records shall be\n\nmaintained for a period of five (5) years from the close of the\n\nfiscal year of the contract period. The State Auditor and Inspector\n\nshall audit each organization annually. The necessary expense of\n\neach audit, including, but not limited to, the cost of typing,\n\nprinting, and binding, shall be paid from funds of the organization.\n\nIn lieu of the audit by the State Auditor and Inspector, the\n\norganization may submit an audit prepared by an independent auditing\n\nfirm for compliance with federal auditing requirements. A copy of\n\nthe audit prepared by or submitted to the State Auditor and\n\nInspector shall be submitted to the Attorney General.\n\nF. Funds for representation of indigent persons in civil legal\n\nmatters shall be limited to family law legal services with priority\n\ngiven to cases involving domestic and family violence and abuse. In\n\nno event shall such funds ever be used for any of the following\n\nactivities:\n\n1. Provision of legal services in a fee-generating case unless\n\nappropriate private representation is not available;\n\n2. Provision of legal services in any criminal proceeding;\n\n3. Provision of legal services collaterally attacking the\n\nvalidity of a criminal conviction;\nolving domestic and family violence and abuse. In\n\nno event shall such funds ever be used for any of the following\n\nactivities:\n\n1. Provision of legal services in a fee-generating case unless\n\nappropriate private representation is not available;\n\n2. Provision of legal services in any criminal proceeding;\n\n3. Provision of legal services collaterally attacking the\n\nvalidity of a criminal conviction;\n\n4. Provision of legal services which seek to procure an\n\nabortion;\n\n5. Provision of legal representation relating to the\n\ndesegregation of any school or school system;\n\n6. Provision of legal services involving any proceeding derived\n\nfrom the Military Selective Service Act;\n\n7. Provision of legal services to advocate for or oppose any\n\naltering of a legislative, judicial, or elective district at any\n\nlevel of government; and\n\n8. Provision of legal services to challenge a census of the\n\nUnited States of America.\n\nG. There is hereby created in the State Treasury a revolving\n\nfund for the Office of the Attorney General to be designated the\n\n\"Legal Services Revolving Fund\". The fund shall be a continuing\n\nfund, not subject to fiscal year limitations, and shall consist of\n\nall monies received by the Office of the Attorney General for\n\nindigent legal services from funds appropriated to the fund, federal\n\nfunds, gifts, donations, and grants. All monies accruing to the\n\ncredit of said fund are hereby appropriated and may be budgeted and\n\nexpended by the Attorney General for the purpose of providing legal\n\nservices to indigent clients pursuant to the provisions of this\n\nsection.
