The defendant in any civil action brought in any court of\n\nthis state by any state agency, board, commission, department,\n\nauthority or bureau authorized to make rules or formulate orders\n\nshall be entitled to recover against such state entity court costs,\n\nwitness fees and reasonable attorney fees if the court determines\n\nthat the action was brought without reasonable basis or is\n\nfrivolous. This subsection shall apply to any action commenced on\n\nor after October 1, 1982.\n\nB. The respondent in any proceeding brought before any state\n\nadministrative tribunal by any state agency, board, commission,\n\ndepartment, authority or bureau authorized to make rules or\n\nformulate orders shall be entitled to recover against such state\n\nentity court costs, witness fees and reasonable attorney fees if the\n\ntribunal or a court of proper jurisdiction determines that the\n\nproceeding was brought without reasonable basis or is frivolous;\n\nprovided, however, if the tribunal is required by law to act upon\n\ncomplaints and determines that the complaint had no reasonable basis\n\nor is frivolous, the tribunal may assess the respondent's costs,\n\nwitness fees and reasonable attorney fees against the complainant.\n\nThis subsection shall apply to any proceeding before any state\n\nadministrative tribunal commenced on or after November 1, 1987.","path":["OK Code","Title 12"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b8560bd6eb64f6c263d9a57ddf805c79eb78684a3e01678cd8667b0b31d575aa","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12-12-940","next":"us-ok/okla.-stat.-tit.-12-12-942"},"notice":"GroundRules: Original legal text.
