Stat. tit. 12, § 12-991","heading":"Right to perfect appeal to Supreme Court without filing","body":"motion for new trial - Exemption.\n\n(a) The right of a party to perfect an appeal from a judgment,\n\norder or decree of the trial court to the Supreme Court shall not be\n\nconditioned upon his having filed in the trial court a motion for a\n\nnew trial, but in the event a motion for a new trial is filed in the\n\ntrial court by a party adversely affected by the judgment, order or\n\ndecree, no appeal to the Supreme Court may be taken until subsequent\n\nto the ruling by the trial court on the motion for a new trial.\n\nThis provision shall not apply, however, to an appeal from an order\n\nof the Corporation Commission.\n\n(b) If a motion for a new trial be filed and a new trial be\n\ndenied, the movant may not, on the appeal, raise allegations of\n\nerror that were available to him at the time of the filing of his\n\nmotion for a new trial but were not therein asserted.","path":["OK Code","Title 12"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4ed800e2b0ed79ccdca9db744fea0a06083df44918d2f5ddd460c9928f47ee10","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12-12-990a","next":"us-ok/okla.-stat.-tit.-12-12-992"},"notice":"GroundRules: Original legal text.
