Stat. tit. 12A, § 12A-1-9-311","heading":"Perfection of security interests in property subject","body":"to certain statutes, regulations, and treaties.\n\nPERFECTION OF SECURITY INTERESTS IN PROPERTY\n\nSUBJECT TO CERTAIN STATUTES, REGULATIONS, AND TREATIES\n\n(a) Except as otherwise provided in subsection (d) of this\n\nsection, the filing of a financing statement is not necessary or\n\neffective to perfect a security interest in property subject to:\n\n(1) a statute, regulation, or treaty of the United States whose\n\nrequirements for a security interest's obtaining priority over the\n\nrights of a lien creditor with respect to the property preempt\n\nsubsection (a) of Section 1-9-310 of this title;\n\n(2) another statute of this state that provides for central\n\nfiling of, or that requires indication on or delivery for indication\n\non a certificate of title of, any security interest in the property\n\nas a condition or result of perfection, including, but not limited\n\nto, Section 1110 of Title 47 and Section 4013 of Title 63 of the\n\nOklahoma Statutes;\n\n(3) a statute of another jurisdiction which provides for a\n\nsecurity interest to be indicated on a certificate of title as a\n\ncondition or result of the security interest's obtaining priority\n\nover the rights of a lien creditor with respect to the property; or\n\n(4) the law or procedure of a federally recognized Indian\n\ntribe, if the security interest is in a vehicle registered or to be\n\nregistered by the federally recognized Indian tribe and if within\n\nthirty (30) days after the security interest attaches, it is noted\n\non the face of a certificate of title issued by the Indian tribe or,\n\nnotwithstanding subsection G of Section 1110 of Title 47 of the\n\nOklahoma Statutes, the security interest is otherwise perfected\n\nunder an applicable law or procedure of that tribe.\n\n(b) Compliance with the requirements of a statute, regulation,\n\nor treaty described in subsection (a) of this section for obtaining\n\npriority over the rights of a lien creditor is equivalent to the\n\nfiling of a financing statement under this article. Except as\n\notherwise provided in subsection (d) of this section and Section 1-\n\n9-313 and subsections (d) and (e) of Section 1-9-316 of this title\n\nfor goods covered by a certificate of title, a security interest in\n\nproperty subject to a statute, regulation, or treaty described in\n\nsubsection (a) of this section may be perfected only by compliance\n\nwith those requirements, and a security interest so perfected\n\nremains perfected notwithstanding a change in the use or transfer of\n\npossession of the collateral.\n\n(c) Except as otherwise provided in subsection (d) of this\n\nsection and subsections (d) and (e) of Section 1-9-316 of this\n\ntitle, duration and renewal of perfection of a security interest\n\nperfected by compliance with the requirements prescribed by a\n\nstatute, regulation, or treaty described in subsection (a) of this\n\nsection are governed by the statute, regulation, or treaty. In\n\nother respects, the security interest is subject to this article.\n\n(d) During any period in which collateral, described in Section\n\n1110 of Title 47 and Section 4013 of Title 63 of the Oklahoma\n\nStatutes, is inventory held for sale or lease by a person or leased\n\nby that person as lessor and that person is in the business of\n\nselling goods of that kind, this section does not apply to a\n\nsecurity interest in that collateral created by that person as\n\ndebtor.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"dbf28fa3bce27019478c35bb3bbdd361df218de94d246fc731e07a858c549c09","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-1-9-310","next":"us-ok/okla.-stat.-tit.-12a-12a-1-9-312"},"notice":"GroundRules: Original legal text.
