Stat. tit. 12A, § 12A-1-9-320.4","heading":"Protection of buyers of farm products, commission","body":"merchants and selling agents.\n\nPROTECTION OF BUYERS OF FARM PRODUCTS,\n\nCOMMISSION MERCHANTS AND SELLING AGENTS\n\nA buyer of farm products, commission merchant, or selling agent\n\nwho purchases or sells farm products in the ordinary course of\n\nbusiness from or for a person engaged in farming operations takes\n\nsubject to a security interest in the farm products if:\n\n(a) (i) the buyer of the farm products, commission merchant,\n\nor selling agent has failed to register with the\n\nOklahoma County Clerk prior to the purchase of the\n\nfarm products and the secured party has filed an\n\neffective financing statement that covers the farm\n\nproducts being sold; or\n\n(ii) the buyer of farm products, commission merchant or\n\nselling agent receives from the Oklahoma County Clerk\n\nwritten notice as provided in paragraph (d) or (f) of\n\nsubsection (4) of Section 1-9-320.6 of this title, and\n\nthe buyer of farm products, commission merchant or\n\nselling agent does not secure a waiver or release of\n\nthe security interest specified in an effective\n\nfinancing statement from the secured party by\n\nperforming any payment obligation or otherwise; or\n\n(b) the secured party or the seller provides written notice of\n\nthe security interest pursuant to the provisions of Section\n\n1-9-320.7 of this title.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f2067ab5a1fbf4bf21b165389f2a8d21a787237ac69450892ada874d2b5b3771","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-1-9-320.3","next":"us-ok/okla.-stat.-tit.-12a-12a-1-9-320.5"},"notice":"GroundRules: Original legal text.
