Stat. tit. 12A, § 12A-1-9-320.6","heading":"Central filing system relating to farm products","body":"CENTRAL FILING SYSTEM RELATING TO FARM PRODUCTS\n\n(1) The Oklahoma County Clerk shall be responsible for\n\ndeveloping and maintaining the central filing system. This\n\nresponsibility shall include obtaining the necessary certification\n\nfor the system from the United States Department of Agriculture\n\n(USDA). The effective date for the implementation of the central\n\nfiling system shall be one hundred eighty (180) days from the\n\ncertification of the central filing system by the USDA.\n\n(2) The Oklahoma County Clerk may promulgate, in accordance\n\nwith laws governing business within its office, appropriate rules\n\nand practices of the filing office in harmony with the rules and\n\npractices of filing offices in other jurisdictions that enact\n\nsubstantially this part and to keep the technology used by the\n\nfiling office compatible with the technology used by filing offices\n\nin other jurisdictions that enact substantially this part. The\n\nOklahoma County Clerk, so far as is consistent with the purposes,\n\npolicies, and provisions of this article in adopting, amending, and\n\nrepealing filing office rules, shall:\n\n(a) consult with filing offices in other jurisdictions\n\nthat enact substantially this part,\n\n(b) consult the International Association of Commercial\n\nAdministrators or any successor organization, and\n\n(c) take into consideration the rules and practices of,\n\nand the technology used by, filing offices in other\n\njurisdictions that enact substantially this part, for\n\nthe implementation and operation of the central filing\n\nsystem.\n\n(3) The central filing system shall conform to the following\n\nrequirements:\n\n(a) The Oklahoma County Clerk shall record the date, hour,\n\nminute, and second of the filing of each effective\n\nfinancing statement;\n\n(b) The Oklahoma County Clerk shall compile all effective\n\nfinancing statements into a master list:\n\n(i) organized according to farm products;\n\n(ii) arranged within each such product:\n\n(A) in alphabetical order according to the last\n\nname of the individual debtors or, in the\n\ncase of debtors doing business other than as\n\nindividuals, the first word in the name of\n\nthe debtors;\n\n(B) in numerical order according to the Social\n\nSecurity number of the individual debtors\n\nor, in the case of debtors doing business\n\nother than as individuals, the Internal\n\nRevenue Service taxpayer identification\n\nnumber of the debtors;\n\n(C) geographically by county produced; and\n\n(D) by crop year; and\n\n(iii) containing the information provided for in\n\nsubparagraph (iv) of paragraph (d) of Section 1-\n\n9-320.2 of this title.\n\n(c) The Oklahoma County Clerk shall maintain records of\n\nall buyers of farm products, commission merchants,\n\nselling agents and others who register with the\n\nOklahoma County Clerk, on a form containing:\n\n(i) the name and address of each registrant;\n\n(ii) the information on the farm product or products\n\nthat the registrant is requesting;\n\n(iii) the name of each county where the product is\n\nproduced or to be produced, or a blanket code\n\ncovering all seventy-seven (77) counties of this\n\nstate; and\n\n(iv) an authorized signature.\nhers who register with the\n\nOklahoma County Clerk, on a form containing:\n\n(i) the name and address of each registrant;\n\n(ii) the information on the farm product or products\n\nthat the registrant is requesting;\n\n(iii) the name of each county where the product is\n\nproduced or to be produced, or a blanket code\n\ncovering all seventy-seven (77) counties of this\n\nstate; and\n\n(iv) an authorized signature.\n\n(d) (i) A copy of those portions of the master list\n\ncovering the information requested by a\n\nregistrant shall be distributed to such\n\nregistrants by the Oklahoma County Clerk on or\n\nbefore the last business day of each month and\n\nshall be presumed to have been received by the\n\nthird business day of the following month.\n\n(ii) Registrants shall be deemed to be registered only\n\nas to those portions of the master list for which\n\nthey register, and shall be deemed to have failed\n\nto register and shall not be considered to be\n\nregistrants as to those portions for which they\n\ndo not register.\n\n(iii) Registrants are subject only to security\n\ninterests shown on the portions of the master\n\nlist which they receive as a consequence of\n\nregistration with the Oklahoma County Clerk.\n\n(iv) If a particular security interest is shown on the\n\nmaster list, but was included since the last\n\nregular distribution of portions of the master\n\nlist to registrants, registrants shall not be\n\nsubject to that security interest;\n\n(e) The duration of the registration with the Oklahoma\n\nCounty Clerk of a buyer of farm products, commission\n\nmerchant, selling agent or other registrant shall be\n\none (1) year from the effective date of the\n\nregistration with the Oklahoma County Clerk.\n\n(f) (i) Upon request, within twenty-four (24) hours of\n\nany inquiry, for information, the Oklahoma County\n\nClerk shall provide confirmation of the existence\n\nor nonexistence of any effective financing\n\nstatement on file. By the close of the business\n\nday following the day on which the request was\n\nreceived, written confirmation of the existence\n\nof an effective financing statement will be\n\nprovided to buyers of farm products, commission\n\nmerchants, and selling agents who have not\n\nregistered, and others who request it.\n\n(ii) The state or political subdivision shall not be\n\nliable if a loss or claim results from any\n\nconfirmation of the existence or nonexistence of\n\nany effective financing statement on file in the\n\nOklahoma County Clerk’s office made in good faith\n\nby an employee of the Oklahoma County Clerk’s\n\noffice as required by the provisions of this\n\nsection.\n\n(4) The filing in the office of the Oklahoma County Clerk under\n\nthis section shall be in addition to the filing requirements\n\nprovided for in this article.\n\n(5) A financing or continuation statement covering farm\n\nproducts that has not lapsed and which was filed pursuant to this\n\ntitle between December 23, 1986, and October 24, 1988, inclusive,\n\nand for which no written notice was furnished as provided in Section\n\n1-9-320.7 of this title, shall become ineffective as to a buyer of\n\nfarm products, commission merchant or selling agent, unless the\n\nsecured party files an effective financing statement in the office\n\nof the Oklahoma County Clerk.\n\n(6) An effective financing statement shall not be deemed filed\n\nin accordance with the provisions of this section until all fees\n\nauthorized by Section 111 of Title 28 of the Oklahoma Statutes\n\nrelating to the filing of the statement are tendered to the Oklahoma\n\nCounty Clerk.\nling agent, unless the\n\nsecured party files an effective financing statement in the office\n\nof the Oklahoma County Clerk.\n\n(6) An effective financing statement shall not be deemed filed\n\nin accordance with the provisions of this section until all fees\n\nauthorized by Section 111 of Title 28 of the Oklahoma Statutes\n\nrelating to the filing of the statement are tendered to the Oklahoma\n\nCounty Clerk.\n\n(7) The secured party shall file a termination statement within\n\ntwenty (20) days after there is no outstanding secured obligation or\n\ncommitment to make advances, incur obligations or otherwise give\n\nvalue. The termination statement shall refer to the unique document\n\nID number. The secured party shall not be required to file a\n\ntermination statement if the debtor, in writing, addressed to the\n\nsecured party, requests that a termination not be filed. The\n\nrequest shall be signed by the debtor or an authorized\n\nrepresentative and the request may be made at any time prior to the\n\nexpiration date of an effective financing statement set forth\n\nherein. If the affected secured party fails to file a termination\n\nstatement as required by this subsection, the party shall be liable\n\nto the Oklahoma County Clerk for Five Hundred Dollars ($500.00). In\n\naddition the affected secured party shall be liable to the debtor\n\nfor any loss caused to the debtor by the failure to terminate the\n\neffective financing statement.\n\n(8) The Oklahoma County District Attorney shall be responsible\n\nfor enforcing the provisions of subsection (7) of this section on\n\nbehalf of the Oklahoma County Clerk and is authorized to take\n\nappropriate actions to collect any penalties owed to the Oklahoma\n\nCounty Clerk pursuant to subsection (7) of this section. When\n\ncollected, the Oklahoma County District Attorney shall cause the\n\npenalty to be deposited into the Oklahoma County Clerk’s Uniform\n\nCommercial Code Central Filing Fund created pursuant to Section 1-9-\n\n525.1 of Title 12A of the Oklahoma Statutes.\n\n(9) As the purpose of an effective financing statement filing\n\nis to ensure that a joint check is made payable to the debtor and\n\nall applicable secured parties, there shall be no priority among\n\nfilings. Filings shall be processed according to the order in which\n\nthey were filed, as recorded in a timestamp within the filing.\n\n(10) All active filings on the effective date of this act, as\n\nprovided in paragraph (1) of this section, shall be filed with the\n\nOklahoma County Clerk’s office. Each active filing that is filed\n\npursuant to the requirements of this paragraph shall be accompanied\n\nwith a transition document that shall be provided by the Oklahoma\n\nCounty Clerk’s office.
