Stat. tit. 12A, § 12A-1-9-322","heading":"Priorities among conflicting security interests in","body":"and agricultural liens on same collateral.\n\nPRIORITIES AMONG CONFLICTING SECURITY INTERESTS\n\nIN AND AGRICULTURAL LIENS ON SAME COLLATERAL\n\n(a) Except as otherwise provided in this section, priority\n\namong conflicting security interests and agricultural liens in the\n\nsame collateral is determined according to the following rules:\n\n(1) Conflicting perfected security interests and agricultural\n\nliens rank according to priority in time of filing or perfection.\n\nPriority dates from the earlier of the time a filing covering the\n\ncollateral is first made or the security interest or agricultural\n\nlien is first perfected, if there is no period thereafter when there\n\nis neither filing nor perfection;\n\n(2) A perfected security interest or agricultural lien has\n\npriority over a conflicting unperfected security interest or\n\nagricultural lien; and\n\n(3) The first security interest or agricultural lien to attach\n\nor become effective has priority if conflicting security interests\n\nand agricultural liens are unperfected.\n\n(b) For the purposes of paragraph (1) of subsection (a) of this\n\nsection:\n\n(1) The time of filing or perfection as to a security interest\n\nin collateral is also the time of filing or perfection as to a\n\nsecurity interest in proceeds; and\n\n(2) The time of filing or perfection as to a security interest\n\nin collateral supported by a supporting obligation is also the time\n\nof filing or perfection as to a security interest in the supporting\n\nobligation.\n\n(c) Except as otherwise provided in subsection (f) of this\n\nsection, a security interest in collateral which qualifies for\n\npriority over a conflicting security interest under Sections 1-9-\n\n327, 1-9-328, 1-9-329, 1-9-330, or 1-9-331 of this title also has\n\npriority over a conflicting security interest in:\n\n(1) Any supporting obligation for the collateral; and\n\n(2) Proceeds of the collateral if:\n\n(A) the security interest in proceeds is perfected;\n\n(B) the proceeds are cash proceeds or of the same type as\n\nthe collateral; and\n\n(C) in the case of proceeds that are proceeds of proceeds,\n\nall intervening proceeds are cash proceeds, proceeds\n\nof the same type as the collateral, or an account\n\nrelating to the collateral.\n\n(d) Subject to subsection (e) of this section and except as\n\notherwise provided in subsection (f) of this section, if a security\n\ninterest in chattel paper, deposit accounts, negotiable documents,\n\ninstruments, investment property, or letter-of-credit rights is\n\nperfected by a method other than filing, conflicting perfected\n\nsecurity interests in proceeds of the collateral rank according to\n\npriority in time of filing.\n\n(e) Subsection (d) of this section applies only if the proceeds\n\nof the collateral are not cash proceeds, chattel paper, negotiable\n\ndocuments, instruments, investment property, or letter-of-credit\n\nrights.\n\n(f) Subsections (a) through (e) of this section are subject to:\n\n(1) subsection (g) of this section and the other provisions of\n\nthis part;\n\n(2) Section 4-210 of this title with respect to a security\n\ninterest of a collecting bank;\n\n(3) Section 5-118 of this title with respect to a security\n\ninterest of an issuer or nominated person; and\n\n(4) Section 1-9-110 of this title with respect to a security\n\ninterest arising under Article 2 or 2A of this title.\n\n(g) A perfected agricultural lien on collateral has priority\n\nover a conflicting security interest in or agricultural lien on the\n\nsame collateral if the statute creating the agricultural lien so\n\nprovides.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1b115f63511dfad0ef6f114a01d39c83476d27c1418290bb4b9b028e844605a0","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-1-9-321","next":"us-ok/okla.-stat.-tit.-12a-12a-1-9-323"},"notice":"GroundRules: Original legal text.
