Stat. tit. 12A, § 12A-1-9-328","heading":"Priority of security interests in investment","body":"property.\n\nPRIORITY OF SECURITY INTERESTS IN INVESTMENT PROPERTY\n\nThe following rules govern priority among conflicting security\n\ninterests in the same investment property:\n\n(1) A security interest held by a secured party having control\n\nof investment property under Section 1-9-106 of this title has\n\npriority over a security interest held by a secured party that does\n\nnot have control of the investment property.\n\n(2) Except as otherwise provided in paragraphs (3) and (4) of\n\nthis section, conflicting security interests held by secured parties\n\neach of which has control under Section 1-9-106 of this title rank\n\naccording to priority in time of:\n\n(A) if the collateral is a security, obtaining control;\n\n(B) if the collateral is a security entitlement carried in\n\na securities account and:\n\n(i) if the secured party obtained control under\n\nparagraph (1) of subsection (d) of Section 8-106\n\nof this title, the secured party’s becoming the\n\nperson for which the securities account is\n\nmaintained;\n\n(ii) if the secured party obtained control under\n\nparagraph (2) of subsection (d) of Section 8-106\n\nof this title, the securities intermediary’s\n\nagreement to comply with the secured party’s\n\nentitlement orders with respect to security\n\nentitlements carried or to be carried in the\n\nsecurities account; or\n\n(iii) if the secured party obtained control through\n\nanother person under paragraph (3) of subsection\n\n(d) of Section 8-106 of this title, the time on\n\nwhich priority would be based under this\n\nparagraph if the other person were the secured\n\nparty; or\n\n(C) if the collateral is a commodity contract carried with\n\na commodity intermediary, the satisfaction of the\n\nrequirement for control specified in paragraph (2) of\n\nsubsection (b) of Section 1-9-106 of this title with\n\nrespect to commodity contracts carried or to be\n\ncarried with the commodity intermediary.\n\n(3) A security interest held by a securities intermediary in a\n\nsecurity entitlement or a securities account maintained with the\n\nsecurities intermediary has priority over a conflicting security\n\ninterest held by another secured party.\n\n(4) A security interest held by a commodity intermediary in a\n\ncommodity contract or a commodity account maintained with the\n\ncommodity intermediary has priority over a conflicting security\n\ninterest held by another secured party.\n\n(5) A security interest in a certificated security in\n\nregistered form which is perfected by taking delivery under\n\nsubsection (a) of Section 1-9-313 of this title and not by control\n\nunder Section 1-9-314 of this title has priority over a conflicting\n\nsecurity interest perfected by a method other than control.\n\n(6) Conflicting security interests created by a broker,\n\nsecurities intermediary, or commodity intermediary which are\n\nperfected without control under Section 1-9-106 of this title rank\n\nequally.\n\n(7) In all other cases, priority among conflicting security\n\ninterests in investment property is governed by Sections 1-9-322 and\n\n1-9-323 of this title.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"fb4b4a6da4000bc52fddfe2b1fa5dbdba219f1821f829a7e3eee803d1f779b96","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-1-9-327","next":"us-ok/okla.-stat.-tit.-12a-12a-1-9-329"},"notice":"GroundRules: Original legal text.
