Stat. tit. 12A, § 12A-1-9-405","heading":"Modification of assigned contract","body":"MODIFICATION OF ASSIGNED CONTRACT\n\n(a) A modification of or substitution for an assigned contract\n\nis effective against an assignee if made in good faith. The\n\nassignee acquires corresponding rights under the modified or\n\nsubstituted contract. The assignment may provide that the\n\nmodification or substitution is a breach of contract by the\n\nassignor. This subsection is subject to subsections (b) through (d)\n\nof this section.\n\n(b) Subsection (a) of this section applies to the extent that:\n\n(1) the right to payment or a part thereof under an assigned\n\ncontract has not been fully earned by performance; or\n\n(2) the right to payment or a part thereof has been fully\n\nearned by performance and the account debtor has not received\n\nnotification of the assignment under subsection (a) of Section 1-9-\n\n406 of this title.\n\n(c) This section is subject to law other than this article\n\nwhich establishes a different rule for an account debtor who is an\n\nindividual and who incurred the obligation primarily for personal,\n\nfamily, or household purposes.\n\n(d) This section does not apply to an assignment of a health-\n\ncare-insurance receivable.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a5711bafbe66a454913a10e2214d7ea66ddda683ed5c19f0421b640194ece058","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-1-9-404","next":"us-ok/okla.-stat.-tit.-12a-12a-1-9-406"},"notice":"GroundRules: Original legal text.
