Stat. tit. 12A, § 12A-1-9-502","heading":"Contents of financing statement; record of mortgage","body":"as financing statement; time of filing financing statement.\n\nCONTENTS OF FINANCING STATEMENT; RECORD OF MORTGAGE AS\n\nFINANCING STATEMENT; TIME OF FILING FINANCING STATEMENT\n\n(a) Subject to subsection (b) of this section, a financing\n\nstatement is sufficient only if it:\n\n(1) provides the name of the debtor;\n\n(2) provides the name of the secured party or a representative\n\nof the secured party; and\n\n(3) indicates the collateral covered by the financing\n\nstatement.\n\n(b) Except as otherwise provided in subsection (b) of Section\n\n1-9-501 of this title, to be sufficient, a financing statement that\n\ncovers as-extracted collateral or timber to be cut, or which is\n\nfiled as a fixture filing and covers goods that are or are to become\n\nfixtures, must satisfy subsection (a) of this section and also:\n\n(1) indicate that it covers this type of collateral;\n\n(2) indicate that it is to be filed against the tract index in\n\nthe real property records;\n\n(3) provide a description of the real property to which the\n\ncollateral is related; and\n\n(4) if the debtor does not have an interest of record in the\n\nreal property, provide the name of a record owner.\n\n(c) A record of a mortgage is effective, from the date of\n\nrecording as a financing statement filed as a fixture filing or as a\n\nfinancing statement covering as-extracted collateral or timber to be\n\ncut only if:\n\n(1) the record indicates the goods or accounts that it covers;\n\n(2) the goods are or are to become fixtures related to the real\n\nproperty described in the record or the collateral is related to the\n\nreal property described in the record and is as-extracted collateral\n\nor timber to be cut;\n\n(3) the record satisfies the requirements for a financing\n\nstatement in this section, but:\n\n(A) the record need not indicate that it is to be filed in\n\nthe real property records; and\n\n(B) the record sufficiently provides the name of a debtor\n\nwho is an individual if it provides the individual\n\nname of the debtor or the surname and first personal\n\nname of the debtor, even if the debtor is an\n\nindividual to whom paragraph (4) of subsection (a) of\n\nSection 1-9-503 of this title applies; and\n\n(4) the record is duly recorded.\n\n(d) A financing statement may be filed before a security\n\nagreement is made or a security interest otherwise attaches.\n\n(e) (1) No filing of a financing statement, continuation\n\nstatement, termination statement, or assignment or release of a\n\nfinancing statement under the provisions of paragraph (1) of\n\nsubsection (a) of Section 1-9-501 of this title shall constitute\n\nrecord notice of the contents thereof against any subsequent\n\npurchaser or encumbrancer of real estate or any interest therein\n\nunless the same contains a legal description of the real estate\n\nadequate for the purposes of indexing in the tract indexes of the\n\ncounty wherein the real estate is situated.\n\n(2) It shall be the duty of the county clerk to cause all such\n\nfinancing statements, continuation statements, termination\n\nstatements, or assignments or releases of financing statements\n\ncontaining an adequate legal description to be recorded and indexed\n\nin the records of said office in the same place and manner as a\n\nmortgage on real estate or assignment or release thereof.\n\n(3) To effectuate the provisions of Section 2A-309 of this\n\ntitle, a lessor of goods that are or are to become fixtures may file\n\na fixture filing complying with that section, and filings related to\n\nthat fixture filing, using the terms \"lessor,\" \"lessee,\" or the like\n\ninstead of the terms specified in this part. The provisions of this\n\narticle relating to a fixture filing or a filing related to it shall\n\napply as appropriate in conjunction with the provisions of Article\n\n2A of this title with respect to such filings.\nfile\n\na fixture filing complying with that section, and filings related to\n\nthat fixture filing, using the terms \"lessor,\" \"lessee,\" or the like\n\ninstead of the terms specified in this part.
