Stat. tit. 12A, § 12A-1-9-516","heading":"What constitutes filing; effectiveness of filing","body":"\n\nWHAT CONSTITUTES FILING; EFFECTIVENESS OF FILING\n\n(a) Except as otherwise provided in subsection (b) of this\n\nsection, communication of a record to a filing office and tender of\n\nthe filing fee or acceptance of the record by the filing office\n\nconstitutes filing.\n\n(b) Filing does not occur with respect to a record that a\n\nfiling office refuses to accept because:\n\n(1) the record is not communicated by a method or medium of\n\ncommunication authorized by the filing office;\n\n(2) an amount equal to or greater than the applicable filing\n\nfee is not tendered;\n\n(3) the filing office is unable to index the record because:\n\n(A) in the case of an initial financing statement, the\n\nrecord does not provide a name for the debtor;\n\n(B) in the case of an amendment or correction statement,\n\nthe record:\n\n(i) does not identify the initial financing statement\n\nas required by Section 1-9-512 or 1-9-518 of this\n\ntitle, as applicable; or\n\n(ii) identifies an initial financing statement whose\n\neffectiveness has lapsed under Section 1-9-515 of\n\nthis title;\n\n(C) in the case of an initial financing statement that\n\nprovides the name of a debtor identified as an\n\nindividual or an amendment that provides a name of a\n\ndebtor identified as an individual which was not\n\npreviously provided in the financing statement to\n\nwhich the record relates, the record does not identify\n\nthe debtor's surname; or\n\n(D) in the case of a record filed or recorded in the\n\nfiling office described in paragraph (1) of subsection\n\n(a) of Section 1-9-501 of this title, the record does\n\nnot provide a sufficient description of the real\n\nproperty to which it relates;\n\n(4) in the case of an initial financing statement or an\n\namendment that adds a secured party of record, the record does not\n\nprovide a name and mailing address for the secured party of record;\n\n(5) in the case of an initial financing statement or an\n\namendment that provides a name of a debtor which was not previously\n\nprovided in the financing statement to which the amendment relates,\n\nthe record does not:\n\n(A) provide a mailing address for the debtor; or\n\n(B) indicate whether the name provided as the name of the\n\ndebtor is the name of an individual or an\n\norganization;\n\n(6) in the case of an assignment reflected in an initial\n\nfinancing statement under paragraph (a) of Section 1-9-514 of this\n\ntitle or an amendment filed under subsection (b) of Section 1-9-514\n\nof this title, the record does not provide a name and mailing\n\naddress for the assignee; or\n\n(7) in the case of a continuation statement, the record is not\n\nfiled within the six-month period prescribed by subsection (d) of\n\nSection 1-9-515 of this title.\n\n(c) For purposes of subsection (b) of this section:\n\n(1) a record does not provide information if the filing office\n\nis unable to read or decipher the information; and\n\n(2) a record that does not indicate that it is an amendment or\n\nidentify an initial financing statement to which it relates, as\n\nrequired by Section 1-9-512, 1-9-514, or 1-9-518 of this title, is\n\nan initial financing statement.\n\n(d) A record that is communicated to the filing office with\n\ntender of the filing fee, but which the filing office refuses to\n\naccept for a reason other than one set forth in subsection (b) of\n\nthis section, is effective as a filed record except as against a\n\npurchaser of the collateral which gives value in reasonable reliance\n\nupon the absence of the record from the files.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"3726cbd6f58750a2544a6be42df33b0e77b7e588e3ab2c4885ec819eb91eaccb","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-1-9-515","next":"us-ok/okla.-stat.-tit.-12a-12a-1-9-517"},"notice":"GroundRules: Original legal text.
