Stat. tit. 12A, § 12A-1-9-526.1","heading":"Procedures for adopting rules","body":"PROCEDURES FOR ADOPTING RULES\n\n(a) The county clerk of Oklahoma County shall adopt rules,\n\npursuant to Section 1-9-526 of this title, for the operation of the\n\nfiling office designated in paragraph (2) of subsection (a) of\n\nSection 1-9-501 of this title. Initial rules for the filing office\n\nshall be adopted on or before January 1, 2001. These rules may be\n\namended or repealed and additional rules may be adopted at any time\n\nin the same manner as initial rules.\n\n(b) The county clerk of Oklahoma County, or a designee, shall\n\nconduct a meeting which complies with the Oklahoma Open Meeting Act\n\nat which public comment regarding the proposed rules may be given\n\nand received orally or in writing.\n\n(c) In addition to any notice required by the Oklahoma Open\n\nMeeting Act, notice shall be given of the proposed rulemaking which\n\nshall:\n\n(1) Be published in at least two newspapers in this state and\n\nin other periodicals and on Internet sites as the county clerk deems\n\nappropriate, at least thirty (30) and no more than sixty (60) days\n\nprior to the meeting at which public comment is invited on the\n\nproposed rules;\n\n(2) Be sent to any person who requests notice of proposed\n\nrulemaking under this section; and\n\n(3) Include the following:\n\n(A) the date, time, and place of the meeting or meetings\n\nat which public comment is invited on the proposed\n\nrules,\n\n(B) the address, telephone number, and Internet address,\n\nif any, for the office to which comments regarding the\n\nrules may be made or a request for a copy of the\n\nproposed rules may be directed,\n\n(C) the deadline for making comments, and\n\n(D) the reason for the proposed rule, repeal, or\n\namendment, and a brief summary of the proposed rule,\n\nrepeal, or amendment, including citations to the\n\nrules.\n\n(d) At the request of any person, the county clerk of Oklahoma\n\nCounty shall provide copies of proposed rules and rules adopted\n\npursuant to this section.\n\n(1) One copy of each proposed rule, repeal, or amendment shall\n\nbe provided free of charge. Additional copies shall be made\n\navailable upon payment of a fee which shall not exceed twenty-five\n\ncents ($0.25) per page plus the cost of mailing, if any.\n\n(2) Copies of rules adopted pursuant to this section shall be\n\nmade available either:\n\n(A) upon payment of a fee which shall not exceed twenty-\n\nfive cents ($0.25) per page plus the cost of mailing,\n\nif any, or\n\n(B) pursuant to subsection (f) of this section, or\n\n(C) a combination of subparagraphs (A) and (B) of this\n\nparagraph.\n\n(e) Proposed rules and rules adopted pursuant to this section\n\nmay also be published on one or more Internet sites designated by\n\nthe county clerk.\n\n(f) The county clerk of Oklahoma County shall, no less than\n\nannually, compile and publish all rules adopted pursuant to this\n\nsection which have been adopted and are effective or have been\n\nadopted and will become effective during the year after publication.\n\nCopies of this compilation shall be made available upon payment of a\n\nfee which shall not exceed Five Dollars ($5.00) plus the cost of\n\nmailing, if any.\n\n(g) The county clerk of Oklahoma County may agree with the\n\nOffice of Administrative Rules in the Office of the Secretary of\n\nState to publish the rules with the Oklahoma Administrative Code.\n\nAn agreement made pursuant to this subsection shall not require\n\ncompliance with the Administrative Procedures Act.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"991def451cda197eab31b6d64c6df616fe5c6b11032b9afec282476349edead5","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-1-9-526","next":"us-ok/okla.-stat.-tit.-12a-12a-1-9-527"},"notice":"GroundRules: Original legal text.
