Stat. tit. 12A, § 12A-1-9-602","heading":"Waiver and variance of rights and duties","body":"WAIVER AND VARIANCE OF RIGHTS AND DUTIES\n\nExcept as otherwise provided in Section 1-9-624 of this title,\n\nto the extent that they give rights to a debtor or obligor and\n\nimpose duties on a secured party, the debtor or obligor may not\n\nwaive or vary the rules stated in the following listed sections:\n\n(1) Subparagraph (C) of paragraph (4) of subsection (b) of\n\nSection 1-9-207 of this title, which deals with use and operation of\n\nthe collateral by the secured party;\n\n(2) Section 1-9-210 of this title, which deals with requests\n\nfor an accounting and requests concerning a list of collateral and\n\nstatement of account;\n\n(3) Subsection (c) of Section 1-9-607 of this title, which\n\ndeals with collection and enforcement of collateral;\n\n(4) Subsection (a) of Section 1-9-608 of this title and\n\nsubsection (c) of Section 1-9-615 of this title to the extent that\n\nthey deal with application or payment of noncash proceeds of\n\ncollection, enforcement, or disposition;\n\n(5) Subsection (a) of Section 1-9-608 of this title and\n\nsubsection (d) of Section 1-9-615 of this title to the extent that\n\nthey require accounting for or payment of surplus proceeds of\n\ncollateral;\n\n(6) Section 1-9-609 of this title to the extent that it imposes\n\nupon a secured party that takes possession of collateral without\n\njudicial process the duty to do so without breach of the peace;\n\n(7) Subsection (b) of Section 1-9-610 of this title and\n\nSections 1-9-611, 1-9-613, and 1-9-614 of this title, which deal\n\nwith disposition of collateral;\n\n(8) Subsection (f) of Section 1-9-615 of this title, which\n\ndeals with calculation of a deficiency or surplus when a disposition\n\nis made to the secured party, a person related to the secured party,\n\nor a secondary obligor;\n\n(9) Section 1-9-616 of this title, which deals with explanation\n\nof the calculation of a surplus or deficiency;\n\n(10) Sections 1-9-620, 1-9-621, and 1-9-622 of this title,\n\nwhich deal with acceptance of collateral in satisfaction of\n\nobligation;\n\n(11) Section 1-9-623 of this title, which deals with redemption\n\nof collateral;\n\n(12) Section 1-9-624 of this title, which deals with\n\npermissible waivers; and\n\n(13) Sections 1-9-625 and 1-9-626 of this title, which deal\n\nwith the secured party’s liability for failure to comply with this\n\narticle.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c1454834332fd4b51edaf0dd85ac87185723fe729a48c582bc796a87736c6295","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-1-9-601","next":"us-ok/okla.-stat.-tit.-12a-12a-1-9-603"},"notice":"GroundRules: Original legal text.
