Stat. tit. 12A, § 12A-1-9-610","heading":"Disposition of collateral after default","body":"DISPOSITION OF COLLATERAL AFTER DEFAULT\n\n(a) After default, a secured party may sell, lease, license, or\n\notherwise dispose of any or all of the collateral in its present\n\ncondition or following any commercially reasonable preparation or\n\nprocessing.\n\n(b) Every aspect of a disposition of collateral, including the\n\nmethod, manner, time, place, and other terms, must be commercially\n\nreasonable. If commercially reasonable, a secured party may dispose\n\nof collateral by public or private proceedings, by one or more\n\ncontracts, as a unit or in parcels, and at any time and place and on\n\nany terms.\n\n(c) A secured party may purchase collateral:\n\n(1) at a public disposition; or\n\n(2) at a private disposition only if the collateral is of a\n\nkind that is customarily sold on a recognized market or the subject\n\nof widely distributed standard price quotations.\n\n(d) A contract for sale, lease, license, or other disposition\n\nincludes the warranties relating to title, possession, quiet\n\nenjoyment, and the like which by operation of law accompany a\n\nvoluntary disposition of property of the kind subject to the\n\ncontract.\n\n(e) A secured party may disclaim or modify warranties under\n\nsubsection (d) of this section:\n\n(1) in a manner that would be effective to disclaim or modify\n\nthe warranties in a voluntary disposition of property of the kind\n\nsubject to the contract of disposition; or\n\n(2) by communicating to the purchaser a record evidencing the\n\ncontract for disposition and including an express disclaimer or\n\nmodification of the warranties.\n\n(f) A record is sufficient to disclaim warranties under\n\nsubsection (e) of this section if it indicates “There is no warranty\n\nrelating to title, possession, quiet enjoyment, or the like in this\n\ndisposition” or uses words of similar import.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8c34439c3ac4dfb42c56b8d9c5176286102fb5e0fbd76ecc5e2e6efd04af00e6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-1-9-609","next":"us-ok/okla.-stat.-tit.-12a-12a-1-9-611"},"notice":"GroundRules: Original legal text.
