Stat. tit. 12A, § 12A-1-9-613","heading":"Contents and form of notification before disposition","body":"of collateral: general.\n\nCONTENTS AND FORM OF NOTIFICATION\n\nBEFORE DISPOSITION OF COLLATERAL: GENERAL\n\n(a) Except in a consumer-goods transaction, the following rules\n\napply:\n\n(1) The contents of a notification of disposition are\n\nsufficient if the notification:\n\n(A) describes the debtor and the secured party;\n\n(B) describes the collateral that is the subject of the\n\nintended disposition;\n\n(C) states the method of intended disposition;\n\n(D) states that the debtor is entitled to an accounting of\n\nthe unpaid indebtedness and states the charge, if any,\n\nfor an accounting; and\n\n(E) states the time and place of a public disposition or\n\nthe time after which any other disposition is to be\n\nmade.\n\n(2) Whether the contents of a notification that lacks any of\n\nthe information specified in paragraph (1) of this section are\n\nnevertheless sufficient is a question of fact.\n\n(3) The contents of a notification providing substantially the\n\ninformation specified in paragraph (1) of this section are\n\nsufficient, even if the notification includes:\n\n(A) information not specified by that paragraph; or\n\n(B) minor errors that are not seriously misleading.\n\n(4) A particular phrasing of the notification is not required.\n\n(5) The following form of notification and the form appearing\n\nin paragraph (3) of subsection (a) of Section 1-9-614 of this title,\n\nwhen completed in accordance with the instructions in subsection (b)\n\nof this section and subsection (b) of Section 1-9-614 of this title,\n\neach provides sufficient information:\n\nNOTIFICATION OF DISPOSITION OF COLLATERAL\n\nTo: (Name of debtor, obligor, or other person to which the\n\nnotification is sent)\n\nFrom: (Name, address, and telephone number of secured party)\n\n{1} Name of any debtor that is not an addressee: (Name of each\n\ndebtor)\n\n{2} We will sell (describe collateral) (to the highest qualified\n\nbidder) at public sale. A sale could include a lease or license.\n\nThe sale will be held as follows:\n\n(Date)\n\n(Time)\n\n(Place)\n\n{3} We will sell (describe collateral) at private sale sometime\n\nafter (date). A sale could include a lease or license.\n\n{4} You are entitled to an accounting of the unpaid indebtedness\n\nsecured by the property that we intend to sell or, as applicable,\n\nlease or license.\n\n{5} If you request an accounting, you must pay a charge of $\n\n(amount).\n\n{6} You may request an accounting by calling us at (telephone\n\nnumber).\n\n[End of Form]\n\n(b) The following instructions apply to the form of\n\nnotification in paragraph (5) of subsection (a) of this section:\n\n(1) The instructions in this paragraph refer to the numbers in\n\nbraces before items in the form of notification in paragraph (5) of\n\nsubsection (a) of this section. Do not include the numbers or\n\nbraces in the notification. The numbers and braces are used only\n\nfor the purpose of these instructions.\n\n(2) Include and complete item {1} only if there is a debtor\n\nthat is not an addressee of the notification and list the name or\n\nnames.\n\n(3) Include and complete either item {2}, if the notification\n\nrelates to a public disposition of the collateral, or item {3}, if\n\nthe notification relates to a private disposition of the collateral.\n\nIf item {2} is included, include the words \"to the highest qualified\n\nbidder\" only if applicable.\n\n(4) Include and complete items {4} and {6}.\n\n(5) Include and complete item {5} only if the sender will\n\ncharge the recipient for an accounting.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"51072ad7404da9fd77234fedafb626b6973fd29d2c667ee66830f6b2d151da14","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-1-9-612","next":"us-ok/okla.-stat.-tit.-12a-12a-1-9-614"},"notice":"GroundRules: Original legal text.
