Stat. tit. 12A, § 12A-1-9-625","heading":"Remedies for secured party’s failure to comply with","body":"article.\n\nREMEDIES FOR SECURED PARTY’S\n\nFAILURE TO COMPLY WITH ARTICLE\n\n(a) If it is established that a secured party is not proceeding\n\nin accordance with this article, a court may order or restrain\n\ncollection, enforcement, or disposition of collateral on appropriate\n\nterms and conditions.\n\n(b) Subject to subsections (c), (d), and (f) of this section, a\n\nperson is liable for damages in the amount of any loss caused by a\n\nfailure to comply with this article. Loss caused by a failure to\n\ncomply may include loss resulting from the debtor’s inability to\n\nobtain, or increased costs of, alternative financing.\n\n(c) Except as otherwise provided in Section 1-9-628 of this\n\ntitle:\n\n(1) a person that, at the time of the failure, was a debtor,\n\nwas an obligor, or held a security interest in or other lien on the\n\ncollateral may recover damages under subsection (b) of this section\n\nfor its loss; and\n\n(2) if the collateral is consumer goods, a person that was a\n\ndebtor or a secondary obligor at the time a secured party failed to\n\ncomply with this part may recover for that failure in any event an\n\namount not less than the credit service charge plus ten percent\n\n(10%) of the principal amount of the obligation or the time-price\n\ndifferential plus ten percent (10%) of the cash price.\n\n(d) A debtor whose deficiency is eliminated under Section 1-9-\n\n626 of this title may recover damages for the loss of any surplus.\n\nHowever, a debtor or secondary obligor whose deficiency is\n\neliminated or reduced under Section 1-9-626 of this title may not\n\notherwise recover under subsection (b) of this section for\n\nnoncompliance with the provisions of this part relating to\n\ncollection, enforcement, disposition, or acceptance.\n\n(e) In addition to any damages recoverable under subsection (b)\n\nof this section, the debtor, consumer obligor, or person named as a\n\ndebtor in a filed record, as applicable, may recover Five Hundred\n\nDollars ($500.00) in each case from a person that:\n\n(1) fails to comply with Section 1-9-208 of this title;\n\n(2) fails to comply with Section 1-9-209 of this title;\n\n(3) files a record that the person is not entitled to file\n\nunder subsection (a) of Section 1-9-509 of this title;\n\n(4) fails to cause the secured party of record to file or send\n\na termination statement as required by subsection (a) or (c) Section\n\n1-9-513 of this title;\n\n(5) fails to comply with paragraph (1) of subsection (b) of\n\nSection 1-9-616 of this title and whose failure is part of a\n\npattern, or consistent with a practice, of noncompliance; or\n\n(6) fails to comply with paragraph (2) of subsection (b) of\n\nSection 1-9-616 of this title.\n\n(f) A debtor or consumer obligor may recover damages under\n\nsubsection (b) of this section and, in addition, Five Hundred\n\nDollars ($500.00) in each case from a person that, without\n\nreasonable cause, fails to comply with a request under Section 1-9-\n\n210 of this title. A recipient of a request under Section 1-9-210\n\nof this title which never claimed an interest in the collateral or\n\nobligations that are the subject of a request under that section has\n\na reasonable excuse for failure to comply with the request within\n\nthe meaning of this subsection.\n\n(g) If a secured party fails to comply with a request regarding\n\na list of collateral or a statement of account under Section 1-9-210\n\nof this title, the secured party may claim a security interest only\n\nas shown in the list or statement included in the request as against\n\na person that is reasonably misled by the failure.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8f83003b598df2658562286ac7de1cedff1ad069f86fe72daa16d486c0a5457d","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-1-9-624","next":"us-ok/okla.-stat.-tit.-12a-12a-1-9-626"},"notice":"GroundRules: Original legal text.
