Stat. tit. 12A, § 12A-1-9-627","heading":"Determination of whether conduct was commercially","body":"reasonable.\n\nDETERMINATION OF WHETHER CONDUCT\n\nWAS COMMERCIALLY REASONABLE\n\n(a) The fact that a greater amount could have been obtained by\n\na collection, enforcement, disposition, or acceptance at a different\n\ntime or in a different method from that selected by the secured\n\nparty is not of itself sufficient to preclude the secured party from\n\nestablishing that the collection, enforcement, disposition, or\n\nacceptance was made in a commercially reasonable manner.\n\n(b) A disposition of collateral is made in a commercially\n\nreasonable manner if the disposition is made:\n\n(1) in the usual manner on any recognized market;\n\n(2) at the price current in any recognized market at the time\n\nof the disposition; or\n\n(3) otherwise in conformity with reasonable commercial\n\npractices among dealers in the type of property that was the subject\n\nof the disposition.\n\n(c) A collection, enforcement, disposition, or acceptance is\n\ncommercially reasonable if it has been approved:\n\n(1) in a judicial proceeding;\n\n(2) by a bona fide creditors’ committee;\n\n(3) by a representative of creditors; or\n\n(4) by an assignee for the benefit of creditors.\n\n(d) Approval under subsection (c) of this section need not be\n\nobtained, and lack of approval does not mean that the collection,\n\nenforcement, disposition, or acceptance is not commercially\n\nreasonable.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e4fd847b211f07b49c2540c120315199f3f22582f37390f1bfd6a4c9aaec8ac8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-1-9-626","next":"us-ok/okla.-stat.-tit.-12a-12a-1-9-628"},"notice":"GroundRules: Original legal text.
