Stat. tit. 12A, § 12A-1-9-710","heading":"Duties of local-filing offices","body":"(a) In this section:\n\n(1) “Local-filing office” means a filing office, other than the\n\nstatewide filing office in the office of the County Clerk of\n\nOklahoma County or the statewide filing office in the office of the\n\nSecretary of State, that is designated as the proper place to file a\n\nfinancing statement under former Article 9 of this title;\n\n(2) (A) “Former-Article 9 records” means:\n\n(i) financing statements and other records that have\n\nbeen filed in a local-filing office before July\n\n1, 2001, and that are, or upon processing and\n\nindexing will be, reflected in the index\n\nmaintained by the local-filing office for filing\n\nfor financing statements and other records filed\n\nin the local-filing office before July 1, 2001,\n\nand\n\n(ii) the index maintained by the local-filing office\n\nas of June 30, 2001, including entries for\n\nfilings completed before July 1, 2001, even\n\nthough processed on or after that date.\n\n(B) “Former-Article 9 records” do not include records\n\npresented to a local-filing office for filing after\n\nJune 30, 2001, whether or not the records relate to\n\nfinancing statements filed in the local-filing office\n\nbefore July 1, 2001; and\n\n(3) “Mortgage”, “as-extracted collateral”, “fixture filing”,\n\n“goods” and “fixtures” have the meanings set forth in this article\n\nof this title.\n\n(b) A local-filing office shall not accept for filing a record\n\npresented after June 30, 2001, whether or not the record relates to\n\na financing statement filed in the local-filing office before July\n\n1, 2001.\n\n(c) Until July 1, 2008, each local-filing office shall maintain\n\nall former-Article 9 records in accordance with former-Article 9. A\n\nformer-Article 9 record which is filed before July 1, 2001, but\n\nwhich is not reflected on the index maintained as of June 30, 2001,\n\nby the local-filing office, shall be processed and indexed and\n\nreflected on the index maintained as of June 30, 2001, as soon as\n\npracticable, but in no event later than July 30, 2001.\n\n(d) Until July 1, 2008, each local-filing office shall respond\n\nto requests for information with respect to former-Article 9 records\n\nrelating to a debtor and shall issue certificates in accordance with\n\nformer-Article 9. The fees for issuing a certificate or for\n\nfurnishing a certified copy of a former-Article 9 record shall be\n\nthe uniform fees provided by subsections (c) and (d) of Section 1-9-\n\n525 of this title.\n\n(e) After June 30, 2008, each local-filing office may remove\n\nand destroy all former-Article 9 records pursuant to Section 155.2\n\nof Title 19 of the Oklahoma Statutes.\n\n(f) This section shall not apply, with respect to financing\n\nstatements and other records, to a filing office in which mortgages\n\nor records of mortgages on real property are required to be filed or\n\nrecorded if:\n\n(1) the collateral is timber to be cut or as-extracted\n\ncollateral, or\n\n(2) the record is or relates to a financing statement files as\n\na fixture filing and the collateral is goods that are or are to\n\nbecome fixtures.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"95e3bd8cfde46924b717ba01716289dacf6ff30f71d29a7fb39c431ca3ef9b80","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-1-9-709","next":"us-ok/okla.-stat.-tit.-12a-12a-1-9-802"},"notice":"GroundRules: Original legal text.
