Stat. tit. 12A, § 12A-1-9-805","heading":"Effectiveness of action taken before effective date","body":"\n\nEFFECTIVENESS OF ACTION TAKEN\n\nBEFORE EFFECTIVE DATE\n\n(a) The filing of a financing statement before this act takes\n\neffect is effective to perfect a security interest to the extent the\n\nfiling would satisfy the applicable requirements for perfection\n\nunder Article 9 of the Uniform Commercial Code as amended by this\n\nact.\n\n(b) This act does not render ineffective an effective financing\n\nstatement that, before this act takes effect, is filed and satisfies\n\nthe applicable requirements for perfection under the law of the\n\njurisdiction governing perfection as provided in Article 9 of the\n\nUniform Commercial Code as it existed before amendment. However,\n\nexcept as otherwise provided in subsections (c) and (d) of this\n\nsection and Section 22 of this act, the financing statement ceases\n\nto be effective:\n\n(1) if the financing statement is filed in this state, at the\n\ntime the financing statement would have ceased to be effective had\n\nthis act not taken effect; or\n\n(2) if the financing statement is filed in another\n\njurisdiction, at the earlier of:\n\n(A) the time the financing statement would have ceased to\n\nbe effective under the law of that jurisdiction; or\n\n(B) June 30, 2018.\n\n(c) The filing of a continuation statement after this act takes\n\neffect does not continue the effectiveness of the financing\n\nstatement filed before this act takes effect. However, upon the\n\ntimely filing of a continuation statement after this act takes\n\neffect on November 1, 2015, and in accordance with the law of the\n\njurisdiction governing perfection as provided in Article 9 of the\n\nUniform Commercial Code as amended by this act, the effectiveness of\n\na financing statement filed in the same office in that jurisdiction\n\nbefore this act takes effect continues for the period provided by\n\nthe law of that jurisdiction.\n\n(d) Subparagraph (B) of paragraph (2) of subsection (b) of this\n\nsection applies to a financing statement that, before this act takes\n\neffect, is filed against a transmitting utility and satisfies the\n\napplicable requirements for perfection under the law of the\n\njurisdiction governing perfection as provided in Article 9 of the\n\nUniform Commercial Code as it existed before amendment only to the\n\nextent Article 9 of the Uniform Commercial Code as amended by this\n\nact provides that the law of a jurisdiction other than the\n\njurisdiction in which the financing statement is filed governs\n\nperfection of a security interest in collateral covered by the\n\nfinancing statement.\n\n(e) A financing statement that includes a financing statement\n\nfiled before this act takes effect and a continuation statement\n\nfiled after this act takes effect is effective only to the extent\n\nthat it satisfies the requirements of Part 5 of Article 9 of the\n\nUniform Commercial Code as amended by this act for an initial\n\nfinancing statement. A financing statement that indicates that the\n\ndebtor is a decedent's estate indicates that the collateral is being\n\nadministered by a personal representative within the meaning of\n\nparagraph (2) of subsection (a) of Section 1-9-503 of Title 12A of\n\nthe Oklahoma Statutes as amended by this act. A financing statement\n\nthat indicates that the debtor is a trust or is a trustee acting\n\nwith respect to property held in trust indicates that the collateral\n\nis held in a trust within the meaning of paragraph (3) of subsection\n\n(a) of Section 1-9-503 of Title 12A of the Oklahoma Statutes as\n\namended by this act.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bdef6c72b3edcd04fa8b280d73cbf91763c2890379fc6c7a67a61767baaa21e2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-1-9-804","next":"us-ok/okla.-stat.-tit.-12a-12a-1-9-806"},"notice":"GroundRules: Original legal text.
