Stat. tit. 12A, § 12A-15-102","heading":"Definitions","body":"DEFINITIONS\n\nIn this act:\n\n(1) \"Agreement\" means the bargain of the parties in fact, as\n\nfound in their language or inferred from other circumstances and\n\nfrom rules, regulations, and procedures given the effect of\n\nagreements under laws otherwise applicable to a particular\n\ntransaction.\n\n(2) \"Automated transaction\" means a transaction conducted or\n\nperformed, in whole or in part, by electronic means or electronic\n\nrecords, in which the acts or records of one or both parties are not\n\nreviewed by an individual in the ordinary course in forming a\n\ncontract, performing under an existing contract, or fulfilling an\n\nobligation required by the transaction.\n\n(3) \"Certification authority\" means a person who issues a\n\ncertificate for a digital signature.\n\n(4) \"Computer program\" means a set of statements or\n\ninstructions to be used directly or indirectly in an information\n\nprocessing system in order to bring about a certain result.\n\n(5) \"Contract\" means the total legal obligation resulting from\n\nthe parties' agreement as affected by this act and other applicable\n\nlaw.\n\n(6) \"Digital signature\" means a type of electronic signature\n\nconsisting of a transformation of an electronic message using an\n\nasymmetric crypto system such that a person having the initial\n\nmessage and the signer's public key can accurately determine\n\nwhether:\n\n(A) The transformation was created using the private key that\n\ncorresponds to the signer's public key; and\n\n(B) The initial message has not been altered since the\n\ntransformation was made.\n\n(7) \"Electronic\" means relating to technology having\n\nelectrical, digital, magnetic, wireless, optical, electromagnetic,\n\nor similar capabilities.\n\n(8) \"Electronic agent\" means a computer program or an\n\nelectronic or other automated means used independently to initiate\n\nan action or respond to electronic records or performances in whole\n\nor in part, without review or action by an individual.\n\n(9) \"Electronic record\" means a record created, generated,\n\nsent, communicated, received, or stored by electronic means. A\n\nrecord or contract that is secured through blockchain technology is\n\nconsidered to be in an electronic form and to be an electronic\n\nrecord.\n\n(10) \"Electronic signature\" means an electronic sound, symbol,\n\nor process attached to or logically associated with a record and\n\nexecuted or adopted by a person with the intent to sign the record.\n\nA signature that is secured through blockchain technology is\n\nconsidered to be in an electronic form and to be an electronic\n\nsignature.\n\n(11) \"Governmental agency\" means an executive, legislative, or\n\njudicial agency, department, board, commission, authority,\n\ninstitution, or instrumentality of the federal government or of a\n\nstate or of a county, municipality, or other political subdivision\n\nof a state.\n\n(12) \"Information\" means data, text, images, sounds, codes,\n\ncomputer programs, software, databases, or the like.\n\n(13) \"Information processing system\" means an electronic system\n\nfor creating, generating, sending, receiving, storing, displaying,\n\nor processing information.\n\n(14) \"Message\" means a digital representation of information.\n\n(15) \"Person\" means an individual, corporation, business trust,\n\nestate, trust, partnership, limited liability company, association,\n\njoint venture, governmental agency, public corporation, or any other\n\nlegal or commercial entity.\n\n(16) \"Record\" means information that is inscribed on a tangible\n\nmedium or that is stored in an electronic or other medium and is\n\nretrievable in perceivable form.\n\n(17) \"Registered certification authority\" means a certification\n\nauthority who is registered with the Secretary and has been\n\ncertified by the Secretary as meeting the standards set forth by\n\nregulation.\n\n(18) \"Secretary\" means the Oklahoma Secretary of State.\nmation that is inscribed on a tangible\n\nmedium or that is stored in an electronic or other medium and is\n\nretrievable in perceivable form.\n\n(17) \"Registered certification authority\" means a certification\n\nauthority who is registered with the Secretary and has been\n\ncertified by the Secretary as meeting the standards set forth by\n\nregulation.\n\n(18) \"Secretary\" means the Oklahoma Secretary of State.\n\n(19) \"Security procedure\" means a procedure employed for the\n\npurpose of verifying that an electronic signature, record, or\n\nperformance is that of a specific person or for detecting changes or\n\nerrors in the information in an electronic record. The term\n\n\"security procedure\" includes a procedure that requires the use of\n\nalgorithms or other codes, identifying words or numbers, encryption,\n\nor callback or other acknowledgment procedures.\n\n(20) \"State\" means a state of the United States, the District\n\nof Columbia, Puerto Rico, the United States Virgin Islands, or any\n\nterritory or insular possession subject to the jurisdiction of the\n\nUnited States.
