Stat. tit. 12A, § 12A-15-108","heading":"Provision of information in writing; presentation of","body":"records.\n\nPROVISION OF INFORMATION IN WRITING; PRESENTATION OF RECORDS\n\n(a) If parties have agreed to conduct a transaction by\n\nelectronic means and a law requires a person to provide, send, or\n\ndeliver information in writing to another person, the requirement is\n\nsatisfied if the information is provided, sent, or delivered, as the\n\ncase may be, in an electronic record capable of retention by the\n\nrecipient at the time of receipt. An electronic record is not\n\ncapable of retention by the recipient if the sender or its\n\ninformation processing system inhibits the ability of the recipient\n\nto print or store the electronic record.\n\n(b) If a law other than this act requires a record (i) to be\n\nposted or displayed in a certain manner, (ii) to be sent,\n\ncommunicated, or transmitted by a specified method, or (iii) to\n\ncontain information that is formatted in a certain manner, the\n\nfollowing rules apply:\n\n(1) The record must be posted or displayed in the manner\n\nspecified in the other law;\n\n(2) Except as otherwise provided in paragraph (2) of subsection\n\n(d) of this section, the record must be sent, communicated, or\n\ntransmitted by the method specified in the other law; and\n\n(3) The record must contain the information formatted in the\n\nmanner specified in the other law.\n\n(c) If a sender inhibits the ability of a recipient to store or\n\nprint an electronic record, the electronic record is not enforceable\n\nagainst the recipient.\n\n(d) The requirements of this section may not be varied by\n\nagreement, but:\n\n(1) to the extent a law other than this act requires\n\ninformation to be provided, sent, or delivered in writing but\n\npermits that requirement to be varied by agreement, the requirement\n\nunder subsection (a) of this section that the information be in the\n\nform of an electronic record capable of retention may also be varied\n\nby agreement; and\n\n(2) a requirement under a law other than this act to send,\n\ncommunicate, or transmit a record by first-class mail, postage\n\nprepaid, or regular United States mail, may be varied by agreement\n\nto the extent permitted by the other law.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0c1145e2b51c24fad77893446076aeabed11d7f14cce583b34d0396b0bb04d7c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-15-107","next":"us-ok/okla.-stat.-tit.-12a-12a-15-109"},"notice":"GroundRules: Original legal text.
