Stat. tit. 12A, § 12A-15-118","heading":"Acceptance and distribution of electronic records by","body":"governmental agencies.\n\nACCEPTANCE AND DISTRIBUTION OF ELECTRONIC RECORDS BY\n\nGOVERNMENTAL AGENCIES\n\n(a) Except as otherwise provided in subsection (f) of Section\n\n12 of this act, each governmental agency of this state shall\n\ndetermine whether, and the extent to which, it will send and accept\n\nelectronic records and electronic signatures to and from other\n\npersons and otherwise create, generate, communicate, store, process,\n\nuse, and rely upon electronic records and electronic signatures.\n\n(b) To the extent that a governmental agency uses electronic\n\nrecords and electronic signatures under subsection (a) of this\n\nsection, the governmental agency, giving due consideration to\n\nsecurity, may specify:\n\n(1) the manner and format in which the electronic records must\n\nbe created, generated, sent, communicated, received, and stored and\n\nthe systems established for those purposes;\n\n(2) if electronic records must be signed by electronic means,\n\nthe type of electronic signature required, the manner and format in\n\nwhich the electronic signature must be affixed to the electronic\n\nrecord, and the identity of, or criteria that must be met by, any\n\nthird party used by a person filing a document to facilitate the\n\nprocess;\n\n(3) control processes and procedures as appropriate to ensure\n\nadequate preservation, disposition, integrity, security,\n\nconfidentiality, and auditability of electronic records; and\n\n(4) any other required attributes for electronic records which\n\nare specified for corresponding nonelectronic records or reasonably\n\nnecessary under the circumstances.\n\n(c) Except as otherwise provided in subsection (f) of Section\n\n12 of this act, this act does not require a governmental agency of\n\nthis state to use or permit the use of electronic records or\n\nelectronic signatures.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ba8616b1178c1eae1ba631a09648928c54b6670e74c842b1a39d858fe9a8eba6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-15-117","next":"us-ok/okla.-stat.-tit.-12a-12a-15-119"},"notice":"GroundRules: Original legal text.
