Stat. tit. 12A, § 12A-15-121","heading":"Registration of certification authorities","body":"(a) No person, other than a state agency, board, or commission,\n\nshall act as a registered certification authority in this state\n\nuntil such person:\n\n(1) Registers with the Secretary on forms approved and provided\n\nby the Secretary;\n\n(2) Files with the Secretary a good and sufficient surety bond,\n\ncertificate of insurance, or other evidence of financial security in\n\nthe amount of Two Hundred Fifty Thousand Dollars ($250,000.00); and\n\n(3) Meets the requirements of any rules promulgated by the\n\nSecretary.\n\n(b) District and appellate court filings shall not be subject\n\nto the rules and regulations promulgated by the Secretary of State,\n\nbut shall require the use of a registered certification authority or\n\nelectronic signature pursuant to rules adopted by the Supreme Court.\n\n(c) If a registered certification authority fails to maintain\n\nany of the qualifications listed in subsection (a) of this section,\n\nthe registration of the certification authority shall be deemed\n\nlapsed.\n\n(d) Any person who knowingly acts as a registered certification\n\nauthority who has not met the requirements set forth in subsection\n\n(a) of this section shall, upon conviction, be guilty of a\n\nmisdemeanor and shall be punished by a fine of not more than One\n\nThousand Dollars ($1,000.00) or up to thirty (30) days in a county\n\njail, or both, for each violation. Each violation shall be a\n\nseparate offense under this section.\n\n(e) Notwithstanding any contractual provisions to the contrary,\n\na certification authority shall be liable for damages suffered by\n\nany person injured as a result of the fraudulent or unauthorized\n\nacts of the certification authority.\n\n(f) In addition to any civil or criminal actions, the Secretary\n\nor the Attorney General may apply to the district court in the\n\ncounty in which a violation of this section has allegedly occurred\n\nfor an order enjoining or restraining the person from continuing the\n\nacts specified in the complaint. The court may grant a temporary or\n\npermanent injunction or restraining order, with or without bond, as\n\nit deems just and proper.\n\n(g) The Secretary is authorized to adopt rules to implement the\n\nprovisions of this section, and related provisions.\n\n(h) The Secretary shall have the authority to establish\n\nreciprocity with other states and nations for purposes of this\n\nsection, and related provisions.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d06d4929c03336fd7e2d371488a68f54bc6aab41949361e0c61500d09358750e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-15-120","next":"us-ok/okla.-stat.-tit.-12a-12a-2-101"},"notice":"GroundRules: Original legal text.
