Stat. tit. 12A, § 12A-2-107","heading":"Goods to be Severed from Realty: Recording","body":"Goods to be Severed from Realty: Recording. - (1) A contract for\n\nthe sale of minerals or the like, including oil and gas, or a\n\nstructure or its materials to be removed from realty is a contract\n\nfor the sale of goods within this article if they are to be severed\n\nby the seller, but until severance, a purported present sale thereof\n\nwhich is not effective as a transfer of an interest in land is\n\neffective only as a contract to sell.\n\n(2) A contract for the sale, apart from the land of growing crops\n\nor other things attached to realty and capable of severance without\n\nmaterial harm thereto, but not described in subsection (1) of this\n\nsection or of timber to be cut is a contract for the sale of goods\n\nwithin this article whether the subject matter is to be severed by\n\nthe buyer or by the seller even though it forms part of the realty\n\nat the time of contracting, and the parties can by identification\n\neffect a present sale before severance.\n\n(3) The provisions of this section are subject to any third party\n\nrights provided by the law relating to realty records, and the\n\ncontract for sale may be executed and recorded as a document\n\ntransferring an interest in land and shall then constitute notice to\n\nthird parties of the buyer's rights under the contract for sale.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"421b883f35ea7fe3f1405c428e248da41b749cd01fe47bf2c59a4f097ca179a6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2-106","next":"us-ok/okla.-stat.-tit.-12a-12a-2-201"},"notice":"GroundRules: Original legal text.
