Stat. tit. 12A, § 12A-2-312","heading":"Warranty of Title and Against Infringement; Buyer's","body":"Obligation Against Infringement.\n\n(1) Subject to subsection (2) there is in a contract for sale a\n\nwarranty by the seller that\n\n(a) the title conveyed shall be good, and its transfer\n\nrightful; and\n\n(b) the goods shall be delivered free from any security\n\ninterest or other lien or encumbrance of which the buyer at the time\n\nof contracting has no knowledge.\n\n(2) A warranty under subsection (1) will be excluded or\n\nmodified only by specific language or by circumstances which give\n\nthe buyer reason to know that the person selling does not claim\n\ntitle in himself or that he is purporting to sell only such right or\n\ntitle as he or a third person may have.\n\n(3) Unless otherwise agreed a seller who is a merchant\n\nregularly dealing in goods of the kind warrants that the goods shall\n\nbe delivered free of the rightful claim of any third person by way\n\nof infringement or the like but a buyer who furnishes specifications\n\nto the seller must hold the seller harmless against any such claim\n\nwhich arises out of compliance with the specifications.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5459ab5401cbee750ab81d6271e3118caaa7d3a4cd646c2456511271c4882590","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2-311","next":"us-ok/okla.-stat.-tit.-12a-12a-2-313"},"notice":"GroundRules: Original legal text.
