Stat. tit. 12A, § 12A-2-313","heading":"Express Warranties by Affirmation, Promise,","body":"Description, Sample.\n\n(1) Express warranties by the seller are created as follows:\n\n(a) Any affirmation of fact or promise made by the sellerto the buyer which relates to the goods and becomes part of the basis of the bargain creates an express warranty that the goods shall conform to the\n\naffirmation or promise.\n\n(b) Any description of the goods which is made part of the\n\nbasis of the bargain creates an express\n\nwarranty that the goods shall conform to the\n\ndescription.\n\n(c) Any sample or model which is made part of the basis of\n\nthe bargain creates an express warranty that\n\nthe whole of the goods shall conform to the\n\nsample or model.\n\n(2) It is not necessary to the creation of an express warranty\n\nthat the seller use formal words such as \"warrant\" or \"guarantee\" or\n\nthat he have a specific intention to make a warranty, but an\n\naffirmation merely of the value of the goods or a statement\n\npurporting to be merely the seller's opinion or commendation of the\n\ngoods does not create a warranty.","path":["OK Code","Title 12A"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os12A.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"59f4c4430c494d0d5ce7e2c9831635d628396a65193e21d8a1190b2e63c6f0ca","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-12a-12a-2-312","next":"us-ok/okla.-stat.-tit.-12a-12a-2-314"},"notice":"GroundRules: Original legal text.
